      In accordance with Article 30 of the Law of the Republic of Kazakhstan ‘On Citizenship of the Republic of Kazakhstan’ and Article 4 of the Law of the Republic of Kazakhstan ‘On legal status of foreign nationals’, I hereby ORDER:

      1. To approve the attached Rules governing the admission, processing and consideration by the internal affairs authorities of applications (application) concerning naturalisation as a citizen of the Republic of Kazakhstan and the renunciation of citizenship of the Republic of Kazakhstan, including under the simplified (registration) procedure, renunciation of citizenship, loss of citizenship, deprivation of citizenship and determination of citizenship of the Republic of Kazakhstan, in accordance with Annex 1 to this order.

      2. To recognize as invalid some orders of the Minister of the Republic of Kazakhstan in accordance with Annex 2 to this order.

      3. The Migration Police Department of the Ministry of Internal Affairs of the Republic of Kazakhstan shall ensure:

      1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

      2) within ten calendar days after state registration in the Ministry of Justice of the Republic of Kazakhstan, send its copy for official publication in periodicals and the information and legal system "Adilet";

      3) send a copy of this order within ten calendar days from the date of its registration to the Republican State Enterprise on the right of economic management of the Republican Centre for Legal Information of the Ministry of Justice of the Republic of Kazakhstan;

      4) place this order on the official Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

      5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, submission to the Legal Department of the Ministry of Internal Affairs of the Republic of Kazakhstan of information on the implementation of the measures provided for in subparagraphs 2), 3) and 4) of this paragraph.

      4. The Migration Police Department of the Ministry of Internal Affairs of the Republic of Kazakhstan, the Departments of Internal Affairs of the cities of Astana, Almaty and regions:

      1) organize the study of this order by the personnel of the migration police subdivision and ensure strict compliance with its requirements;

      2) ensure the production of application forms, certificates and journals (Annex 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13 to the Rules).

      5. Control over the execution of this order shall be entrusted to the Deputy Minister of Internal Affairs of the Republic of Kazakhstan E.Z. Turgumbayev and the Migration Police Department of the Ministry of Internal Affairs of the Republic of Kazakhstan (S.S. Sainov).

      6. This order shall enter into force upon expiry of ten calendar days after the date of its first official publication.

Rules for the admission, registration and consideration by the internal affairs bodies of applications (applications) on issues of admission to citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan, including in a simplified (registration) procedure, renunciation of citizenship, loss, deprivation of citizenship and determination of citizenship of the Republic of Kazakhstan

Chapter 1. General provisions

      1. These Rules for admission, processing and consideration by the internal affairs authorities (applications) on issues of admission to citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan, including in the simplified (registration) procedure for renouncing citizenship of the Republic of Kazakhstan (hereinafter referred to as the Rules) has been developed in accordance with Article 30 of the Law of the Republic of Kazakhstan "On citizenship of the Republic of Kazakhstan" (hereinafter referred to as the Law), Article 4 of the Law of the Republic of Kazakhstan "On legal status of foreigners."

      2. The following terms shall be used in these Rules:

      1) applicant – an individual who filed an appeal with an administrative body, an official for the implementation of an administrative procedure, as well as an individual in respect of whom an administrative act shall be adopted, an administrative action (inaction) shall be performed (addressee of an administrative act);

      2) administrative act - a decision taken by an administrative body, official in public law relations, implementing the rights and obligations of a certain person or an individually defined circle of individuals established by the Laws of the Republic of Kazakhstan;

      3) administrative body - a state body, a local government body, a state legal entity, as well as another organization that, in accordance with the Laws of the Republic of Kazakhstan, shall be empowered to adopt an administrative act, perform an administrative action (inaction);

      4) administrative procedure - the activity of an administrative body, official in the consideration of an administrative case, the adoption and execution of a decision on it, carried out on the basis of an appeal or on its own initiative, as well as activities carried out in the procedure of a simplified administrative procedure;

      5) citizens of the former Soviet republics - citizens of the former Union of Soviet Socialist Republics;

      6) rehabilitated victims of mass political repression - individuals recognized in court or other procedure established by the Law as a victim of political repression;

      7) foreigners and stateless persons who have received a permanent residence permit in the procedure determined by the Rules for issuing temporary and permanent residence permits to foreigners and stateless persons in the Republic of Kazakhstan, approved by the order of the Minister of Internal Affairs of the Republic of Kazakhstan dated December 4, 2015 № 992 (registered in the Register of State Registration of Regulatory Legal Acts № 12880);

      8) Repatriate - ethnic Kazakhs who permanently resided at the time of the acquisition of sovereignty by the Republic of Kazakhstan outside its borders, and their children of Kazakh nationality who were born and permanently resided after the acquisition of sovereignty by the Republic of Kazakhstan outside its borders, arrived (arrived) in the Republic of Kazakhstan for the purpose of permanent residence in their historical homeland and received (received) the appropriate status in the manner prescribed by the Law of the Republic of Kazakhstan "On population migration";

      9) ethnic Kazakhs - foreigners or stateless persons of Kazakh nationality permanently residing abroad.

Chapter 2. Procedure for admission, registration and consideration of applications (applications) on issues of admission to citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan, including in the simplified (registration) procedure, renunciation of citizenship, loss, deprivation of citizenship and determination of citizenship of the Republic of Kazakhstan

      3. Admission of applications (applications) on issues of admission to citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan, including in a simplified (registration) procedure, renunciation of citizenship, loss, deprivation of citizenship and determination of belonging to citizenship of the Republic of Kazakhstan for individuals living in the territory of the Republic of Kazakhstan, shall be carried out by the internal affairs authorities of the Republic of Kazakhstan at the place of permanent residence of the applicant.

      The decision on admission to citizenship, procedure for renouncing citizenship, renunciation of citizenship of the Republic of Kazakhstan shall be made by the President of the Republic of Kazakhstan.

      The grounds for refusal to accept and renunciation of citizenship of the Republic of Kazakhstan shall be provided for in Article 17 of the Law of the Republic of Kazakhstan "On citizenship of the Republic of Kazakhstan."

      Complaints about decisions on citizenship and loss of citizenship shall be submitted to the President of the Republic of Kazakhstan.

      The decision on citizenship issues may be revised by the President of the Republic of Kazakhstan.

      Unjustified refusal to accept an application on citizenship issues, violation of the terms for considering applications, as well as other illegal actions of officials that violate the procedure for considering citizenship cases and the procedure for executing decisions on citizenship issues can be appealed in the administrative (pre-trial) procedure provided for in Chapter 13 of the Administrative Procedure Code (hereinafter referred to as the Code) to a higher official in the order of subordination.

      Administrative (pre-trial) consideration of the complaint shall be carried out by the higher administrative body (official) considering the complaint.

      The complaint shall be submitted to the administrative body (official), whose administrative act, administrative action (inaction) shall be appealed.

      The administrative body (official) whose decision, action (inaction) shall be appealed, no later than three working days from the date of receipt of the complaint, send it and the administrative case to the body considering the complaint.

      At the same time, the administrative body (official) whose decision, action (inaction) shall be appealed, has the right not to send a complaint to the body considering the complaint, if it makes a decision or other administrative action that fully satisfies the requirements specified in the complaint within three working days.

      The complaint shall be considered within the time frame established by the Code.

      The materials on citizenship received by the internal affairs authorities of the Republic of Kazakhstan shall be checked for the reason for changing citizenship and the completeness of personal information, the correctness of the spelling of the Last name, name and patronymic (if any) of the applicant and his family members.

      If the applicant submits an incomplete package of documents or the lack of completeness of personal information in accordance with these Rules, the official within three working days shall send a notification to the applicant indicating which requirements the package of documents shall not meet.

      If within three working days from the date of receipt of the notification, the applicant has not provided a complete package of documents and/or has not eliminated the shortcomings in the submitted documents, the official shall send a notice of refusal to consider the application.

      The application (application) shall be deemed accepted for execution from the date of submission by the applicant of all documents provided for by these Rules. In application forms for admission and renunciation of citizenship of the Republic of Kazakhstan, an appropriate entry shall be made, which is certified by the signature of the employee who accepted the material for consideration.

      Applications (applications) for admission to citizenship and renunciation of citizenship, including in a simplified (registration) procedure, renunciation of citizenship, loss, deprivation of citizenship and determination of citizenship shall be subject to registration in the register of applications (applications) of individuals in the form in accordance with Annex 1-1 to these Rules and consideration.

      Persons who have submitted an application (application) for acquiring citizenship of the Republic of Kazakhstan or for renouncing citizenship, upon their request, shall be issued a certificate of acceptance of documents in the form in accordance with Annex 2 to these Rules. The certificate shall be issued by the Police Department (hereinafter referred to as the PD) only after entering information about an individual applying for citizenship through the Migration police information system, followed by attaching electronic copies of all documents necessary for acquiring citizenship of the Republic of Kazakhstan or renouncing citizenship to the Single Information System "Berkut" (hereinafter referred to as the SIS "Berkut") and obtaining results.

      When issuing certificates from applicants, originals of identity documents or their electronic form, provided through the digital document service, shall be required to verify with copies attached to the case file.

      At the same time, certificates of state registration of acts of civil status, identity documents issued on the territory of the Republic of Kazakhstan and used in electronic form through the service of digital documents shall be provided in printed form.

      Consideration of applications (applications) on issues of admission to citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan shall be carried out from the date of submission of the application (applications) within 6 (six) months, in a simplified manner within 3 (three) months.

      4. Properly executed materials shall be sent by the district internal affairs body at the place of residence of the applicant under the subordination to the PD of regions, cities of republican significance and the capital.

      The PD of regions, cities of republican significance and the capital shall check the correctness of the registration of materials on citizenship issues, start cases, enter information about the applicant through the Information System of the Migration Police in the SIS "Berkut," issue a reasoned opinion on it and within ten calendar days shall send it to the Ministry of Internal Affairs of the Republic of Kazakhstan (hereinafter referred to as the Ministry of Internal Affairs of the Republic of Kazakhstan).

      5. A person applying for citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan, including simplified (registration) procedure, renunciation of citizenship, loss, deprivation of citizenship and determination of citizenship of the Republic of Kazakhstan, the internal affairs authorities of the Republic of Kazakhstan request information on the presence or absence of a criminal record, bringing to administrative responsibility in the department of legal statistics and special records of the prosecutor's office through the information exchange system of law enforcement and special bodies of the Republic of Kazakhstan (hereinafter referred to as the IESLESB), check for all accounts of the internal affairs bodies of the Republic of Kazakhstan and enter information through the Migration Police Information System in the SIS "Berkut." through the SIS channels, “Berkut” shall send materials for approval to the national security agencies of the Republic of Kazakhstan.

      6. Based on the results of consideration of applications (applications) for admission to the citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan, including in the simplified (registration) procedure, renunciation of citizenship, loss, deprivation of citizenship and determination of belonging to the citizenship of the Republic of Kazakhstan, a reasoned conclusion is issued, which details the verification data characterizing the applicant.

      7. The conclusion on the issues of admission to citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan, including in the simplified (registration) procedure, renunciation of citizenship, loss, deprivation of citizenship and determination of belonging to the citizenship of the Republic of Kazakhstan, shall be drawn up in any form and approved by the head of the PD or his deputy.

      8. The Ministry of Internal Affairs of the Republic of Kazakhstan shall approve materials on admission, renunciation of citizenship of the Republic of Kazakhstan, renunciation of citizenship of the Republic of Kazakhstan and shall send them to the State Legal Department of the Administration of the President of the Republic of Kazakhstan, and the formed list of persons applying for admission, renunciation and renunciation of citizenship of the Republic of Kazakhstan shall be sent for information to the National Security Committee, in accordance with the plan of the Commission on Citizenship under the President of the Republic of Kazakhstan.

      Improperly issued materials shall be returned to the PD of regions, cities of republican significance and the capital to be brought in line with the Law. The deadline for eliminating the shortcomings shall be ten calendar days, then the materials shall be re-sent to the Ministry of Internal Affairs of the Republic of Kazakhstan.

      If the deficiencies are not eliminated due to the absence of the applicant at the place of residence or late receipt of a response from the competent authorities of other states, the consideration of applications (applications) shall be suspended, about which the applicant shall be sent a notification within five working days, a copy of which shall be attached to the case file.

      9. If the application (application) is rejected by the internal affairs body of the Republic of Kazakhstan, which provided materials on admission to citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan, including in the simplified (registration) procedure, renunciation of citizenship in advance, but no later than three working days before the adoption of the administrative act, the applicant is sent a notice of hearing to express a position on the preliminary decision on the administrative case. The hearing shall be held no later than 2 business days from the date of notification.

      Based on the results of the hearing, a decision shall be made on further consideration of the application (application), if there is a basis for refusing to accept, to restore (withdraw) citizenship of the Republic of Kazakhstan, a certificate of refusal to accept, to restore (withdraw) citizenship of the Republic of Kazakhstan shall be sent to the applicant in the form in accordance with Annex 3 to these Rules indicating the motive for refusal. The second copy of the certificate shall be attached to the applicant's personal file.

      10. An application (application) for admission, renunciation of citizenship of the Republic of Kazakhstan and renunciation of citizenship of the Republic of Kazakhstan in relation to persons under the age of 18, as well as recognized as incapacitated, shall be submitted by their legal representatives, certified by a notary, jointly with a copy of the child's birth certificate (adoptive parents, guardians and trustees submit a copy of the decision of the local executive body) or with an identity document of the incapacitated person. At the same time, a notarized consent of a minor child aged 14 to 18 shall be required, which shall be signed by him and submitted, simultaneously with the petition (application) of the parents or their legal representatives.

      The parents' petition (application) shall be accompanied by copies of the birth certificates of children specified in the application forms in accordance with Annexes 4 and 5 to these Rules.

      11. The term for consideration of applications (applications) in the district and city bodies of internal affairs, the PD, the Ministry of Internal Affairs of the Republic of Kazakhstan and state bodies of the Republic of Kazakhstan shall be one month in each of these bodies, and in total - six months.

      12. The Ministry of Internal Affairs of the Republic of Kazakhstan, upon receipt of the Decree of the President of the Republic of Kazakhstan on the admission and renunciation of citizenship, renunciation of citizenship within five calendar days, shall notify the PD that submitted the materials.

      Upon receipt of the Decree of the President of the Republic of Kazakhstan, the PD, through the city bodies of internal affairs at the place of residence of the applicants, within five calendar days shall notify them of the results of consideration of applications (applications).

      If a person has changed his place of residence, the internal affairs bodies of the Republic of Kazakhstan immediately send a message about the decision made to the internal affairs bodies at the applicant's new place of residence.

      The Ministry of Internal Affairs of the Republic of Kazakhstan shall be informed about the execution of the Decree of the President of the Republic of Kazakhstan within a period not exceeding one month from the date of signing the Decree.

      13. The citizenship of a child in the event of a change in the citizenship of the parents and during adoption will be determined in accordance with the Law of the Republic of Kazakhstan "On Citizenship of the Republic of Kazakhstan" (hereinafter referred to as the Law).

      14. In accordance with Article 33 of the Law, the request (application) shall be signed by another person, and the notary shall make the corresponding inscription on the application.

Chapter 3. Procedure for admission to citizenship of the Republic of Kazakhstan

      15. Citizenship of the Republic of Kazakhstan shall be accepted:

      1) persons permanently residing in the territory of the Republic of Kazakhstan legally for at least five years or married to citizens of the Republic of Kazakhstan for at least three years. At the time of filing an application (application) for admission to the citizenship of the Republic of Kazakhstan, the period of residence or marriage must be continuous.

      The presence of the procedure provided for in part one of this subparagraph shall not be required when admitting minors to the citizenship of the Republic of Kazakhstan, incapacitated and persons who have special services to the Republic of Kazakhstan, or have professions and meet the requirements according to the list approved by the Decree of the President of the Republic of Kazakhstan dated June 6, 2005 № 1587 "On approval of the list of professions and requirements for persons, in respect of which a simplified procedure for admission to citizenship of the Republic of Kazakhstan" and members of their families shall be established;

      2) citizens of the former union republics who arrived with the aim of permanent residence in the Republic of Kazakhstan, having one of the close relatives - citizens of the Republic of Kazakhstan: a child (including an adopted one), a spouse (spouse), one of the parents (adoptive parents), a sister, a brother, a grandfather or a grandmother, regardless of their period of residence in the Republic of Kazakhstan.

      16. In accordance with Article 38 of the Law, the period of residence in the territory of the republic shall include:

      1) the time of service in the army, if the person previously lived in the territory of the republic and the break between the day of dismissal from the army and the day of arrival in the Republic of Kazakhstan for permanent residence does not exceed three months;

      2) the time of study outside the republic, if the break between graduation or expulsion from the educational institution and the day of arrival in the Republic of Kazakhstan shall not exceed three months;

      3) travel time outside the republic, if the break between the end of the business trip and the day of arrival in the Republic of Kazakhstan shall not exceed three months.

      The calculation of a three-month period shall be suspended in case of illness, natural disaster or for other valid reasons.

      The period of residence on the territory of the Republic of Kazakhstan shall not count the time of serving the criminal penalties appointed by the court of the Republic of Kazakhstan and (or) judicial authorities of other states, as well as the period of stay on the territory of the republic on a business trip, on treatment and other cases of temporary residence.

      The period of residence on the territory of the Republic of Kazakhstan shall not count the period preceding the abolition of a person's citizenship of the Republic of Kazakhstan.

      17. Persons permanently residing in the Republic of Kazakhstan shall submit applications (applications) for admission to the citizenship of the Republic of Kazakhstan addressed to the President of the Republic of Kazakhstan and shall submit it to the internal affairs bodies of the Republic of Kazakhstan at the place of permanent residence.

      The petition (application) shall reflect the motives for accepting citizenship of the Republic of Kazakhstan.

      18. The following documents shall be attached to the application for citizenship of the Republic of Kazakhstan:

      1) application form according to Annex 4 to the Rules;

      2) autobiography;

      3) four photographs measuring 3.5 x 4.5 centimetres (hereinafter referred to as cm);

      4) the obligation to comply with the conditions provided for in Article 1 of the Law in the form in accordance with Annex 6 to these Rules;

      5) a copy of an identity document confirming belonging to the citizenship of another state, a certificate of a stateless person, a birth certificate of a child;

      6) certificate of the absence or termination of citizenship of another state issued by the competent authority of the state concerned (except for the persons specified in the second part of subparagraph 1) of paragraph 15 of these Rules, who have applied in writing to the internal affairs bodies for admission to the citizenship of the Republic of Kazakhstan and at the same time to an official of the state of arrival making a decision on citizenship issues, with a notarized written renunciation of foreign citizenship. A copy of the application for renunciation of former citizenship is attached to the materials on admission to citizenship);

      7) a document on payment of the state duty or exemption from its payment;

      8) a certificate confirming knowledge of the state language at an elementary level, the foundations of the Constitution of the Republic of Kazakhstan, as well as the history of Kazakhstan to the extent determined by the authorized body in the field of science and higher education, in accordance with subparagraph 14) of Article 17 of the Law.

      In addition to the listed documents, they shall represent:

      persons who shall meet the requirements of the list of professions and requirements for persons in respect of whom a simplified procedure for admission to citizenship of the Republic of Kazakhstan shall be established, approved by Decree of the President of the Republic of Kazakhstan dated June 6, 2005 № 1587 - application of the relevant state body;

      A person applying for citizenship of the Republic of Kazakhstan, who shall be married to a citizen of the Republic of Kazakhstan at the time of filing an application (application), shall submit a notarized copy of the marriage certificate.

      Citizens of the former union republics who arrived with the aim of permanent residence in the Republic of Kazakhstan and shall have one of their close relatives - citizens of the Republic of Kazakhstan - submit documents certifying the degree of kinship with citizens of the Republic of Kazakhstan (birth certificate, marriage certificate, etc.).

      Documents drawn up in a foreign language shall be translated into Kazakh or Russian.

      In accordance with Article 80 of the Law of the Republic of Kazakhstan "On Notaries," the notary shall testify to the accuracy of the translation from one language to another. According to paragraph 60 of the Consular Charter of the Republic of Kazakhstan, approved by Decree of the President of the Republic of Kazakhstan dated April 25, 2016 № 240, documents and acts drawn up with the participation of the authorities of foreign states or emanating from these authorities shall be accepted for consideration if there is legalization, unless otherwise provided by the legislation of the Republic of Kazakhstan or international treaties ratified by the Republic of Kazakhstan.

Chapter 4. Procedure for renunciation of citizenship of the Republic of Kazakhstan

      19. A person who was previously a citizen of the Republic of Kazakhstan, at his request (application), shall be restored to citizenship of the Republic of Kazakhstan. The provisions of the subparagraph 1of the paragraph 15 of these Rules shall not apply to a person who was previously a citizen of the Republic of Kazakhstan. However, a person in respect of whom the loss of citizenship of the Republic of Kazakhstan was previously registered shall be accepted into the citizenship of the Republic of Kazakhstan on a general basis.

      A request (application) for renunciation of citizenship of the Republic of Kazakhstan shall be submitted to the President of the Republic of Kazakhstan.

      The following documents shall be attached to the application (application) for renunciation of citizenship of the Republic of Kazakhstan:

      1) application form according to Annex 4 to the Rules;

      2) autobiography;

      3) four photographs measuring 3.5 x 4.5 cm;

      4) the obligation to comply with the conditions provided for in Article 1 of the Law in the form in accordance with Annex 6 to these Rules;

      5) a copy of the identity document;

      6) a certificate of the absence or termination of citizenship of another state issued by the competent authority of the relevant state;

      7) a document on payment of the state duty or exemption from its payment;

      8) a copy of the document certifying the former belonging to the citizenship of the Republic of Kazakhstan.

      9) a certificate confirming knowledge of the state language at an elementary level, the foundations of the Constitution of the Republic of Kazakhstan, as well as the history of Kazakhstan to the extent determined by the authorized body in the field of science and higher education, in accordance with subparagraph 14) of Article 17 of the Law.

      Documents drawn up in a foreign language shall be translated into Kazakh or Russian.

      In accordance with Article 80 of the Law of the Republic of Kazakhstan "On Notaries," the accuracy of the translation from one language to another shall be evidenced by a notary if he speaks the relevant languages. If the notary does not speak the relevant languages, the translation can be made by a translator, the authenticity of the signature of which shall be evidenced by the notary.

      According to Annex 60 of the Consular Charter of the Republic of Kazakhstan, approved by the Decree of the President of the Republic of Kazakhstan dated April 25, 2016 № 240, documents and acts drawn up with the participation of the authorities of foreign states or emanating from these authorities shall be accepted for consideration if there is legalization, unless otherwise provided by the legislation of the Republic of Kazakhstan or international treaties ratified by the Republic of Kazakhstan.

      20. The internal affairs authorities shall issue a certificate of admission to citizenship, renunciation of citizenship of the Republic of Kazakhstan, certified by a seal in accordance with Annex 7 to these Rules, which is the basis for documenting with an identity card and passport of a citizen of the Republic of Kazakhstan, and deregister them as foreigners or stateless persons.

Chapter 5. The procedure for admission to citizenship of the Republic of Kazakhstan in a simplified (registration) manner

      21. In accordance with the Agreements of 26 February 1999 (ratified by the Law of the Republic of Kazakhstan of December 30, 1999) (hereinafter referred to as the Agreement), citizens of the Russian Federation, the Republic of Belarus and the Kyrgyz Republic fall under the simplified procedure for admission to citizenship of the Republic of Kazakhstan.

      To acquire citizenship of the Republic of Kazakhstan in a simplified manner and terminate citizenship, the other Parties shall request (apply) to the head of the PD of the regions and at the same time to the official of the state of arrival, making decisions on citizenship issues, with a notarized written renunciation of foreign citizenship.

      The following documents shall be attached to the application:

      1) application form according to Annex 4 to the Rules;

      2) autobiography (free form);

      3) notarized application for renunciation of former citizenship;

      4) four photographs measuring 3.5 x 4.5 cm;

      5) obligation to comply with the conditions provided for in Article 1 of the Law in the form in accordance with Annex 6 to these Rules;

      6) a copy of an identity document confirming citizenship of one of the countries participating in the Agreement;

      7) a notarized copy of the birth and marriage certificate;

      8) a document on payment of state duty or exemption from its payment.

      22. If necessary, a document confirming the existence of one of the conditions necessary for the adoption of citizenship in a simplified manner shall be additionally submitted. Copies of a birth certificate, passport, other document confirming birth in the territory of the Republic of Kazakhstan, a copy of the passport page with a mark of registration at the place of residence until December 21, 1991 in the territory of the Party of acquired citizenship or a certificate of the competent authority about it, a copy of a marriage certificate, birth certificate or other document confirming family ties with a citizen of the Republic of Kazakhstan.

      23. In accordance with the Convention on the Nationality of Married Women of 29 January 1957 (ratified by the Law of the Republic of Kazakhstan of January 5, 2000), a foreigner permanently residing in the territory of the Republic of Kazakhstan legally and married to a citizen of Kazakhstan, shall submit a request (application) for admission to citizenship of the Republic of Kazakhstan in a simplified manner addressed to the head of the PD of the regions and at the same time to the official of the state of arrival, making a decision on citizenship issues, with a notarized written renunciation of foreign citizenship.

      The following documents shall be attached to the application:

      1) notarized application for renunciation of former citizenship;

      2) application form according to Annex 4 to these Rules;

      3) four photographs measuring 3.5 x 4.5 cm;

      4) the obligation to comply with the conditions provided for in Article 1 of the Law in the form in accordance with Annex 6 to these Rules;

      5) a copy of the document confirming belonging to the citizenship of a foreign state;

      6) a copy of the marriage certificate;

      7) a copy of the identity card of the spouse - a citizen of the Republic of Kazakhstan;

      8) a document on payment of state duty or exemption from its payment.

      24. In accordance with the Law, repatriate permanently residing in the territory of the Republic of Kazakhstan legally, regardless of the period of residence, rehabilitated victims of mass political repression, as well as their descendants, deprived or lost citizenship without their free will, permanently residing in the territory of the Republic of Kazakhstan legally, regardless of the period of residence, ethnic Kazakhs studying in higher educational institutions to acquire citizenship of the Republic of Kazakhstan in simplified (registration) manner shall apply with a request (application) addressed to the head of the PD of regions, cities of republican significance and the capital.

      The following documents shall be attached to the request (application) for admission to the citizenship of the Republic of Kazakhstan:

      1) notarized application for renunciation of former citizenship;

      2) application form according to Annex 4 to these Rules;

      3) four photographs measuring 3.5 x 4.5 cm;

      4) the obligation to comply with the conditions provided for in Article 1 of the Law in the form in accordance with Annex 6 to these Rules;

      5) a copy of an identity document confirming belonging to the citizenship of another state;

      6) autobiography;

      7) a repatriate permanently residing in the territory of the Republic of Kazakhstan - certificate of a repatriate;

      8) ethnic Kazakhs studying in higher educational institutions - a certificate from a higher educational institution confirming the fact of study in this institution;

      9) certificate of confirmation of nationality for ethnic Kazakhs studying in higher educational institutions;

      10) a document on payment of the state duty or exemption from its payment;

      11) persons who shall be victims of political repression - a court decision on rehabilitation or documents confirming that they shall be a descendant of victims of political repression.

      24-1. A repatriate who shall not have permanent registration shall apply to the head of the PD for a permanent residence permit and admission of citizenship of the Republic of Kazakhstan in a simplified (registration) manner, and at the same time to the official of the state of arrival making decisions on citizenship issues, with a notarized written renunciation of foreign citizenship.

      The following documents shall be attached to the request (application):

      1) application form for the issuance of a permanent residence permit and registration of admission to citizenship of the Republic of Kazakhstan, in the form in accordance with Annex 7-1 to these Rules;

      2) notarized application for renunciation of former citizenship;

      3) obligation to comply with the conditions provided for in Article 1 of the Law;

      4) a copy and original (for verification) of the national passport, or a document of a stateless person;

      5) a copy and original (for verification) of a birth certificate or other identity document of a child under the age of sixteen when jointly applied;

      6) personal autobiography in Kazakh or Russian;

      7) a document on criminal record (no criminal record) in the state of nationality and or permanent residence issued by the competent authority of the relevant state (with the exception of ethnic Kazakhs of citizens of the People's Republic of China, unless otherwise provided by international treaties);

      8) notarized application of an individual or legal entity to provide the applicant with a dwelling for living and registration;

      9) a certificate of medical examination of a foreigner about the absence of diseases, the presence of which shall prohibit entry to foreigners and stateless persons in the Republic of Kazakhstan, in accordance with the order of the Minister of Healthcare of the Republic of Kazakhstan dated September 30, 2011 № 664 "On approval of the list of diseases, the presence of which prohibits entry to foreigners and stateless persons in the Republic of Kazakhstan" (registered in the Register of State Registration of Regulatory Legal Acts № 7274);

      10) minors aged 14 to 18 years shall attach their notarized written consent to the parents' application;

      11) four photographs measuring 3.5x4.5 cm.

      12) a document on the payment of state duty.

      13) a certificate of fingerprinting of a foreigner or stateless person, issued in accordance with the procedure determined by the internal affairs authorities in accordance with subparagraph 1) of the Article 32 of the Law of the Republic of Kazakhstan "On fingerprinting and genomic registration."

      25. When petitioners apply in a simplified (registration) manner, copies of documents (passport, birth certificate, marriage certificate, application for renunciation of previous citizenship) submitted to the request (application) shall be certified by notary.

      Documents drawn up in a foreign language shall be translated into Kazakh or Russian.

      According to paragraph 60 of the Consular Charter of the Republic of Kazakhstan, approved by the Decree of the President of the Republic of Kazakhstan dated April 25, 2016 № 240, documents and acts drawn up with the participation of the authorities of foreign states or emanating from these authorities shall be accepted for consideration if there is legalization, unless otherwise provided by the legislation of the Republic of Kazakhstan or international treaties ratified by the Republic of Kazakhstan.

      26. Based on the results of consideration of requests (applications), a reasoned opinion shall be issued, which shall be approved by the head of the PD or his deputy, which shall be notified to the city authorities of internal affairs who have submitted materials on issues related to the simplified procedure for acquiring citizenship of the Republic of Kazakhstan by sending a certificate of admission to citizenship of the Republic of Kazakhstan in the form in accordance with Annex 7 to these Rules. Upon receipt of decisions from the PD, the internal affairs bodies shall notify the applicant of the results of consideration of requests (applications) and issue a certificate certified by a seal, which shall be the basis for documenting the identity card and passport of a citizen of the Republic of Kazakhstan, and deregister them as foreigners. The receipt of the certificate for acquisition of citizenship shall be sent to the PD for inclusion in the materials.

      Simultaneously with the certificate of admission to the citizenship of the Republic of Kazakhstan, persons admitted to citizenship in a simplified manner shall receive notice of obligations in the form in accordance with Annex 8 to these Rules. The second copy of the notice shall be attached to the applicant's personal file.

      27. If the applicant has changed the place of residence during the consideration of the request (application) for acquisition of citizenship, a message on the results of consideration of the application is sent to the internal affairs body at the new place of residence.

      28. A request (application) for admission to citizenship or renunciation of citizenship of the Republic of Kazakhstan shall be rejected if there are grounds provided for by Article 17 of the Law.

      29. The term for consideration of materials on the simplified (registration) procedure for acquiring citizenship of the Republic of Kazakhstan shall be three months from the date of submission of the request (application).

      30. Citizenship of children under 18 shall be determined in accordance with the provisions of the Agreements.

      31. Upon receipt of information from the competent authorities of the countries participating in the Agreements on the acceptance by a citizen of the Republic of Kazakhstan of citizenship of another state, the internal affairs bodies shall introduce amendments the database of the documented population of the Republic of Kazakhstan.

Chapter 6. Procedure for renouncing citizenship of the Republic of Kazakhstan

      32. A citizen of the Republic of Kazakhstan permanently residing in the territory of the Republic shall submit a petition (application) for renunciation of citizenship of the Republic of Kazakhstan addressed to the President of the Republic of Kazakhstan and submit it to the internal affairs body of the Republic of Kazakhstan at the place of permanent residence.

      The petition (application) shall be accompanied by:

      1) application form according to Annex 5 to the Rules;

      2) autobiography;

      3) three photographs measuring 3.5 x 4.5 cm;

      4) copies of identity documents, birth and marriage certificates;

      5) a certificate from the place of work, study, as well as from the territorial body of enforcement proceedings on the presence or absence of unfulfilled obligations to the state or property obligations related to the interests of citizens, state authorities and organizations, regardless of the form of ownership;

      6) a certificate from the territorial department for defence on the release of a person of military age from active military service or the impossibility of release;

      7) a document on payment of the state duty or exemption from its payment.

      33. If the applicant has a spouse or dependent individuals in the Republic of Kazakhstan, he shall submit a notarized statement of these persons about the absence of material and other claims against him.

      34. Notarized copies of documents on divorce, death of one of the parents, adoption, guardianship and guardianship (decision of the relevant local executive body), deprivation of parental rights, payment of alimony.

      If both parents are citizens of the Republic of Kazakhstan and one of them withdraws from the citizenship of the Republic of Kazakhstan, while simultaneously applying for the renunciation of the citizenship of a minor child, then a notarized statement of the other parent shall be submitted, which expresses his attitude to the child's renunciation of the citizenship of the Republic of Kazakhstan.

      35. When issuing an application form for renouncing the citizenship of the Republic of Kazakhstan, the applicant shall be explained the legal and other consequences of losing his citizenship of the Republic of Kazakhstan, which shall be recorded in the certificate in the form in accordance with Annex 9 to these Rules, attached to the materials and signed by the applicant.

      36. In the conclusions drawn up by the PD in any form at the request of (applications) for renunciation of citizenship of the Republic of Kazakhstan shall be provided with accurate information about the applicant's unfulfilled obligations to the state or his property obligations, with which the essential interests of citizens or enterprises, institutions and organizations shall be connected, public associations, on bringing him to criminal responsibility as an accused, or about serving a sentence on a court verdict that has entered into legal force, or that the withdrawal of this person from citizenship shall be contrary to the interests of state security of the Republic of Kazakhstan, the reasons and motives for the renunciation of citizenship.

      37. The PD shall seize identity cards and passports of a citizen of the Republic of Kazakhstan from persons in respect of whom decisions have been made to renounce citizenship of the Republic of Kazakhstan and issue certificates of renunciation of citizenship of the Republic of Kazakhstan in the form in accordance with Annex 10 to these Rules in accordance with paragraph 10 of these Rules.

      38. Renunciation of citizenship of the Republic of Kazakhstan shall be refused if the person applying for renunciation has unfulfilled obligations to the Republic of Kazakhstan or property obligations with which the essential interests of citizens or enterprises, institutions and organizations, public associations located on the territory of the Republic of Kazakhstan shall be associated.

      Renunciation of the citizenship of the Republic of Kazakhstan shall not be allowed if the person applying for withdrawal is brought to criminal responsibility as an accused or is serving a sentence on a court verdict that has entered into force, or if the person's renunciation of the citizenship of the Republic of Kazakhstan shall be contrary to the interests of state security of the Republic of Kazakhstan.

Chapter 7. Procedure for registration of loss of citizenship of the Republic of Kazakhstan

      39. Citizenship of the Republic of Kazakhstan shall be lost on the grounds provided for in Article 21 of the Law.

      40. Upon receipt of information and statements that a person, a citizen of the Republic of Kazakhstan living on an identity card or passport shall not be a citizen of the Republic of Kazakhstan, the internal affairs authorities of the Republic of Kazakhstan have documents confirming that they belong to the citizenship of another state, within three working days they shall check for bringing to administrative responsibility in the subdivision of legal statistics and special records of the prosecutor's office through the IESLESB, check for all accounts of the internal affairs bodies of the Republic of Kazakhstan and the SIS "Berkut" to confirm departure or entry into the Republic of Kazakhstan.

      Based on the results of the audit, a reasoned conclusion is issued within two days, which is approved by the head of the DP or the supervising deputy.

      If a violation of the legislation of the Republic of Kazakhstan on citizenship is detected, a person staying in the territory of the Republic of Kazakhstan in relation to whom the loss of citizenship is registered is brought to administrative responsibility in accordance with the requirements of the Code of the Republic of Kazakhstan "On Administrative Offenses.

      40-1. To register the loss of citizenship of the Republic of Kazakhstan, on the basis of the information received, the official shall form verification material from the following documents:

      1) the grounds (information) that served to carry out verification measures for further registration of the loss of citizenship of the Republic of Kazakhstan;

      2) information confirming the registration of a passport and (or) identity card of the Republic of Kazakhstan (in the absence of original documents);

      3) information on crossing the border from the SIS "Berkut";

      4) information from the IESLESB, on all accounts of the internal affairs authorities of the Republic of Kazakhstan;

      5) a document confirming the presence of citizenship of a foreign state.

      In the absence of documents confirming the existence of citizenship of a foreign state in relation to a person, a request shall be sent to the competent authorities of the foreign state.

      If it is impossible to consider information or applications within the prescribed period due to the lack of confirming the presence of citizenship of a foreign state, registration of loss of citizenship shall be suspended until confirmation of the presence of citizenship of a foreign state shall be received. A copy of the request shall be attached to the case file.

      40-2. To register the loss of citizenship, a person permanently residing in the territory of the Republic of Kazakhstan and taking the citizenship of another state, within thirty calendar days shall submit the following documents to the internal affairs authorities:

      1) application for registration of loss of citizenship of the Republic of Kazakhstan in any form;

      2) passport and (or) identity card of a citizen of the Republic of Kazakhstan (original);

      in case of loss of passport and (or) identity card of the Republic of Kazakhstan, the person shall give a written explanation.

      3) a copy of the passport of a citizen of a foreign state or a document confirming the presence of foreign citizenship;

      The official shall draw up a protocol on the seizure of identity documents.

      41. Registration of the loss of citizenship of the Republic of Kazakhstan shall be carried out only after sending a notification to a person registered in the territory of the Republic of Kazakhstan about the reasons and grounds for making a decision on the loss of citizenship of the Republic of Kazakhstan.

      The internal affairs authorities of the Republic of Kazakhstan shall register the loss of citizenship of the Republic of Kazakhstan in the register of persons who have lost citizenship of the Republic of Kazakhstan in the form in accordance with Annex 11 to these Rules.

      The internal affairs bodies shall enter information about persons who have lost their citizenship of the Republic of Kazakhstan within ten working days into the database of the documented population of the Republic of Kazakhstan and inform the Border Service of the National Security Committee of the Republic of Kazakhstan.

      Upon receipt of information from the authorized state body of the Republic of Kazakhstan that a person permanently registered in the territory of the Republic of Kazakhstan has taken part in foreign armed conflicts, extremist and (or) terrorist activities on the territory of a foreign state, the internal affairs authorities in relation to this person shall register the loss of citizenship of the Republic of Kazakhstan.

      41-1. In case of loss of citizenship of parents, the child's citizenship shall be determined in accordance with the Law of the Republic of Kazakhstan "On Citizenship of the Republic of Kazakhstan."

Chapter 8. Procedure for determining citizenship of the Republic of Kazakhstan

      42. Determination of belonging to the citizenship of the Republic of Kazakhstan shall be subject to persons:

      1) with passports of the USSR of the 1974 model or having lost them, which shall not have permanent registration in the Republic of Kazakhstan as of March 1, 1992;

      2) over eighteen years of age who shall have not received identity documents of a citizen of the Republic of Kazakhstan, which shall not be listed in the database of the documented population and shall not have confirmation of permanent registration in apartment or household books;

      4) those born on the territory of the Republic of Kazakhstan and not being citizens of a foreign state;

      5) persons in respect of whom a request for their extradition has been received.

      43. Individuals who shall apply to the head of the PD of regions, cities of republican significance and the capital to determine their citizenship of the Republic of Kazakhstan and shall submit it to the subdivisions of the migration service of the city bodies of internal affairs at the place of permanent residence, in the absence of registration at the place of actual residence.

      The following documents shall be attached to the request (application):

      1) a document confirming the existence of one of the conditions specified in paragraph 42 of the Rules;

      2) autobiography;

      3) four photographs measuring 3.5 x 4.5 cm;

      4) other documents related to the case (birth certificate, employment record book, military ID, certificate of secondary or incomplete secondary education, diploma, archival certificate - extract from the household book, if necessary, statements of at least three witnesses confirming the fact of residence in the Republic of Kazakhstan).

      When forming a material on determining citizenship, the internal affairs bodies of the Republic of Kazakhstan at the place of residence draw up a survey protocol in the form in accordance with Annex 12 to these Rules.

      The term for consideration of requests (applications) shall be thirty calendar days.

      If it is impossible to consider requests (applications) within the prescribed period due to the lack of a response from the foreign office of the Ministry of Foreign Affairs of the Republic of Kazakhstan, the consideration of the request (application) shall be suspended, about which the applicant shall be sent a notification, a copy of which shall be attached to the case file.

      44. Persons whose citizenship of the Republic of Kazakhstan has been established shall be issued a certificate in accordance with Annex 13 to these Rules, which shall be the basis for documenting them with passports and identity cards of a citizen of the Republic of Kazakhstan.

      Persons whose citizenship of the Republic of Kazakhstan has not been established by the internal affairs bodies shall be documented by certificates of a stateless person.

Chapter 9. Procedure for deprivation of citizenship.

      Footnote.       45. Deprivation of citizenship of the Republic of Kazakhstan shall be allowed only by a court decision for committing terrorist crimes, as well as for causing other serious harm to the vital interests of the Republic of Kazakhstan in cases provided for by the Criminal Code of the Republic of Kazakhstan.

      46. Deprivation of citizenship shall not be assigned to persons who have committed a crime under the age of eighteen.

      47. After the entry into force of the court verdict on the deprivation of citizenship of the Republic of Kazakhstan, the internal affairs authorities shall issue an opinion (in any form) on the registration of deprivation of citizenship, which shall be approved by the head of the PD of regions, cities of republican significance and the capital or their deputies.

      48. Within ten working days from the date of approval of the conclusion, the internal affairs authorities shall enter information on persons deprived of citizenship of the Republic of Kazakhstan into the database of the documented population of the Republic of Kazakhstan.

Notification-obligation

      In accordance with the Article 10 of the Constitution of the Republic of Kazakhstan for a citizen
