      In accordance with paragraph 139 of the Rules for doing military service in the Armed Forces, other troops and military formations of the Republic of Kazakhstan, approved by Decree No. 124 of the President of the Republic of Kazakhstan dated May 25, 2006, I hereby ORDER:

      1. Approve the attached Rules for recalling a serviceman of internal affairs bodies from the basic annual leave by service exigency.

      2. In accordance with the procedure established by the legislation of the Republic of Kazakhstan, the Chief command of the National Guard of the Republic of Kazakhstan shall:

      1) provide the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

      2) post this order on the Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

      3) report to the Legal Department of the Ministry of Internal Affairs of the Republic of Kazakhstan on execution of the actions provided for in subparagraphs 1) and 2) of this paragraph within ten calendar days from the date of the state registration.

      3. Control over the execution of this order shall be assigned to the Deputy Minister of Internal Affairs of the Republic of Kazakhstan, Police Major General, A.D. Kalaychidi.

      4. This order shall take effect upon expiry of ten calendar days after the date of its first official publication.

The rules for recalling a serviceman of internal affairs bodies from the basic annual leave by service exigency

      1. These Rules for recalling a serviceman of internal affairs bodies from the basic annual leave by service exigency (hereinafter - the Rules) have been developed in accordance with paragraph 139 of the Rules for doing military service in the Armed Forces, other troops and military formations of the Republic of Kazakhstan, approved by Decree No. 124 of the President of the Republic of Kazakhstan dated May 25, 2006 (hereinafter - the Rules for doing Military Service) and define the procedure for recalling a serviceman of internal affairs bodies (hereinafter - a serviceman) from the basic annual leave (hereinafter - the leave) by service exigency.

      2. A serviceman shall be recalled from the leave by service exigency upon notification of the command of the unit (institution).

      3. An order (command) on recalling from the leave by service exigency shall be communicated to a serviceman verbally on behalf of the commander (chief) of a military unit (institution) by an official to whom he is directly subordinate, indicating the reason for recalling. In cases where it is impossible to communicate a verbal order (command) to a serviceman, the headquarters of a military unit (institution) shall notify the body in which the serviceman registers for military service, in accordance with paragraph 113 of the Rules for doing military service.

      4. The recall of a serviceman from leave due to official necessity is carried out on the following grounds:

      when a unit or military unit (institution) is relocated;

      in case of emergency incidents in a military unit (institution), such as the death of a serviceman, group abandonment of a place of service by military personnel, loss of carriers of information constituting state secrets, weapons, equipment, material or financial means, manifestation of mass non-statutory relationships;

      in the event of emergency situations (social, natural or man-made), in the liquidation of the consequences of emergency situations and in bringing to the highest degrees of combat or operational readiness, based on the operational situation by the decision of the commander (chief) of a military unit (institution);

      when carrying out organizational and staff activities in a military unit (institution), if the period of transition to a new staff expires before the release of the serviceman from vacation;

      in other cases of official necessity by the decision of the Minister of Internal Affairs of the Republic of Kazakhstan, the Commander-in-Chief of the National Guard of the Republic of Kazakhstan, the commanders of the regional commands of the National Guard of the Republic of Kazakhstan.

      5. The part of the basic annual leave unused in connection with the recall shall be granted to a serviceman in accordance with paragraph 122 of the Rules for doing military service.
