      In accordance with paragraph 2-1 of Article 7 of the Law of the Republic of Kazakhstan dated January 6, 2011 "On Law Enforcement Service", I HEREBY ORDER:

      1. To approve the Selection Rules for initial vocational training and the conditions for its passage for persons entering the internal affairs bodies, as well as the grounds for their expel from initial vocational training in accordance with the annex to this Order.

      2. To recognize as terminated the Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated April 26, 2011, No. 187 "On approval of the Rules for passing special initial training for persons entering the internal affairs bodies of the Republic of Kazakhstan for the first time as privates, junior and middle commanding personnel" (registered in the Register of state registration of regulatory legal acts No. 6978, published on June 8, 2011, in the "Kazakhstanskaya Pravda" newspaper No. 180 (26601)).

      3. The Department of Personnel Policy of the Ministry of Internal Affairs of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

      1) state registration of this Order with the Ministry of Justice of the Republic of Kazakhstan;

      2) posting this Order on the Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

      3) within ten working days after the state registration of this Order, submission to the Legal Department of the Ministry of Internal Affairs of the Republic of Kazakhstan the information on the implementation of the measures provided for in subparagraphs 1) and 2) of this paragraph.

      4. Control over the implementation of this Order shall be entrusted to the supervising Deputy Minister of Internal Affairs of the Republic of Kazakhstan.

      5. This Order shall come into effect on January 1, 2021, and is subject to mandatory official publication.

The Selection Rules for initial vocational training and the conditions for its passage for persons entering the internal affairs bodies, as well as the grounds for their expel from initial vocational training

Chapter 1. General Provisions

      1. These Selection Rules for initial vocational training and the conditions for its passage for persons entering the internal affairs bodies, as well as the grounds for their expel from initial vocational training (hereinafter referred to as the Rules) have been developed in accordance with the Law of the Republic of Kazakhstan dated January 6, 2011 "On Law Enforcement Service" (hereinafter referred to as the Law) and shall determine the organization, the procedure for selection for initial vocational training, the conditions for its passage for persons entering the internal affairs bodies, as well as the grounds for their expel from initial vocational training.

      2. Candidates for service in the internal affairs bodies (hereinafter referred to as IAB) for the positions of privates, junior and middle commanding personnel be admitted after they undergo initial professional training in educational organizations of the Ministry of Internal Affairs of the Republic of Kazakhstan (hereinafter referred to as the Ministry of Internal Affairs).

      3. Requirements for filling the posts of privates, junior and middle commanding personnel shall be determined by the Law, Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated November 19, 2015, No. 941 "On approval of the List of specialties to meet the requirements for personnel, taking into account personnel planning in the internal affairs bodies" (registered in the Register of state registration of regulatory legal acts No. 12442) and qualification requirements for the categories of positions of the internal affairs bodies of the Republic of Kazakhstan.

      4. The costs of participation in the selection for initial vocational training (travel to the place of selection and back, the passage of a medical examination, renting accommodation, accommodation) shall be paid by the candidate at his own expense.

Chapter 2. Organization of selection for initial vocational training

      5. Annually, the personnel policy subdivision of the central office of the Ministry of Internal Affairs, until December 1, shall develop and approve by the Minister of Internal Affairs a schedule of initial professional training for the next calendar year based on applications submitted by the personnel service units of the Ministry of Internal Affairs departments, territorial bodies under the jurisdiction of the Ministry of Internal Affairs and its departments, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments.

      6. Organization of the selection of candidates for initial vocational training in the organization of education of the Ministry of Internal Affairs shall be carried out by the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments, which have vacant positions.

      7. Organization of work on the selection of candidates shall be entrusted to the personnel service of the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments, and shall include a range of activities:

      1) informational and organizational;

      2) study of information about the candidate;

      3) sending candidates for medical examination to the military medical commissions of the Internal Affairs Directorate (hereinafter referred to as MMC) to determine aptitude for service and polygraph examination;

      4) formation of personal files of candidates;

      5) sending candidates to the educational organization of the Ministry of Internal Affairs and their files, for selection for initial vocational training.

      8. Informing the population shall include the publication in the mass media of information on vacant positions and qualification requirements for them, on the procedure for admission to service in the police department and on the conditions of service, the date of the beginning and end of acceptance of documents.

      9. Citizens wishing to take part in the selection shall submit to the personnel services of the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, state institutions under the jurisdiction of the Ministry of Internal Affairs, and its departments, an application for participation in the selection, in any form, the documents listed in subparagraphs 2), 3), 4), 5), 6), 7) and 9), 10), 11), 14) and 15) of paragraph 17 of the Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated August 31, 2016, No. 870 "On approval of the List positions in the internal affairs bodies of the Republic of Kazakhstan, filled on a competitive basis, the Rules for the competition and internships when entering the service of the internal affairs bodies of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts No. 14305) (hereinafter referred to as the Competition Rules).

      10. After submission of the documents specified in paragraph 9 of this Order, the candidate shall be given directions for passing:

      1) medical and psychophysiological examination in military medical commissions (hereinafter referred to as MMC) in the form, according to Annex 1 to the Rules for conducting the military-medical examination in the internal affairs bodies of the Republic of Kazakhstan, approved by Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated November 2, 2020 No. 758 (registered in the Register of state registration of regulatory legal acts No. 21580).

      The MMC shall inform the personnel service of the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments about the results of the medical examination of the candidate within three days;

      2) a polygraph examination in the appropriate department of the Internal Affairs Department, in the form in accordance with Annex 1 to the Rules for passing a polygraph examination in law enforcement bodies of the Republic of Kazakhstan, approved by the Government of the Republic of Kazakhstan dated June 19, 2014, No. 683, after passing the MMC.

      10-1. In accordance with paragraph 6 of Article 11 of the Law, the candidate shall take a written commitment in the form in accordance with Annex 1-1 to these Rules, that upon completion of the initial vocational training in the educational organization of the Ministry of Internal Affairs, he shall undertake to serve in the internal affairs bodies of the Republic of Kazakhstan for at least three years.

      11. Simultaneously with the issuance of referrals for medical and psychophysiological examination, polygraph examination, by employees of the personnel service of the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments concerning them, as well as close relatives specified in the personal sheet shall be checked against the records of the information service of the Committee on Legal Statistics and Special Records of the General Prosecutor's Office of the Republic of Kazakhstan.

      12. After receiving the results of the medical and psychophysiological examination, polygraph examination, personal files shall be formed in accordance with the requirements of Annex 5 to the Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated May 27, 2011, No. 246 "Some issues of service in the internal affairs bodies of the Republic of Kazakhstan" (registered in the State Registration Register of Regulatory Legal Acts under No. 7032).

      13. In case of negative results of the medical and psychophysiological examination and (or) verification, a written reasoned refusal shall be sent to the candidate, indicating the possibility of re-submission of documents for participation in the selection after recovery and (or) the expiration of the terms specified in subparagraphs 5), 6) and 6-1) paragraph 2 of Article 6 of the Law.

      14. Materials for conducting a mandatory special check shall be stored in the personnel services of the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, state institutions under the jurisdiction of the Ministry of Internal Affairs, and its departments, which sent candidates, and after enrolling them as students for initial vocational training, shall be sent to the units of the national security agencies. The results of a special check shall be stored in the personnel services of the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments.

      In case of a negative result of a special check, a letter shall be sent to the education organization of the Ministry of Internal Affairs about the need to expel the candidate from the initial vocational training.

Chapter 3. Procedure for selection for initial vocational training

      14. The selection of candidates for initial vocational training shall be the responsibility of the selection committee.

      The selection committee shall be created by order of the head of educational organizations of the Ministry of Internal Affairs. The selection committee shall consist of at least five people, the head of the education organization of the Ministry of Internal Affairs shall be appointed as the chairman of the selection committee.

      The selection committee shall include representatives of their security services, personnel services of departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, who have vacant positions, for which they are selected for initial vocational training, public associations.

      15. The selection of candidates for initial vocational training shall include a range of successive stages:

      1) at the first stage - lists of candidates shall be formed based on received personal files;

      2) at the second stage - passing the candidates of standards for physical training in accordance with the requirements of the Competition Rules.

      2) at the third stage - the selection committee shall interview the candidates, and at the request of the candidate with the invitation of his parents, the candidate's spouse. The motives of the candidate's admission to service in the Department of Internal Affairs shall be determined. The attention of the candidate shall be drawn to the existing restrictions on the service, the nature of future activities, his possible involvement in the service at inopportune hours, weekends, and holidays, as well as to the benefits and advantages when serving in the police department.

      Each stage of selection shall be allowed only once. A candidate who has not passed the previous stage shall not be allowed to the next stage.

      16. The selection results shall be drawn up in a protocol, the results of which are the basis for enrollment of candidates in the number of students of the education organization of the Ministry of Internal Affairs, by signing an order by the head of the educational organization of the Ministry of Internal Affairs and concluding a contract, in the form according to Annex 1 to these Rules.

      A copy of the order on the enrollment of the student for initial vocational training, no later than one working day, shall be handed over to the personnel service of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs and its departments, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments.

      17. The order on the enrollment of the student for initial vocational training shall be the basis for appointing the student as an intern of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs and its departments, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments.

      Initial vocational training shall count towards the internship period.

      For the period of the internship, the department of the Ministry of Internal Affairs, a territorial body under the jurisdiction of the Ministry of Internal Affairs and its department, a state institution under the jurisdiction of the Ministry of Internal Affairs and its department with a trainee within three working days from the date of signing the order for enrolling him for initial vocational training, an employment contract shall be concluded in educational organizations of the Ministry of Internal Affairs.

      The student, in accordance with the employment contract, for the period of the internship shall be paid the official salary provided for the position held by the staffing table, as well as other payments established for the relevant categories of employees who do not have special ranks.

Chapter 4. Conditions for completing initial vocational training

      18. A student of initial vocational training (hereinafter referred to as Students) shall have:

      1) identity card;

      2) camouflage uniforms for the season: summer - caps, jacket, trousers, camouflage T-shirt and black high-top boots; winter - a jacket, trousers or overalls warmed in camouflage colors, as well as a knitted woolen hat and high-top boots, warmed in black;

      3) sportswear and shoes;

      4) personal hygiene items;

      5) writing materials.

      19. Students shall be provided with food and accommodation at the expense of budget funds.

      20. The term of training on initial professional training in the areas of training of employees of operational, investigative, operational-forensic departments shall be 6 months, the rest areas - 3 months.

      21. Initial vocational training shall be carried out in accordance with the model curricula developed by the Ministry of Internal Affairs and the curriculum approved by the head of the educational organization of the Ministry of Internal Affairs.

      The organization of education The Ministry of Internal Affairs shall independently determine the form, procedure for conducting the current and final control of knowledge and shall be established by the decision of the collegial management body of the educational organization.

      One academic hour for all types of training sessions shall be at least 40 minutes.

      22. The knowledge of students in all types of training sessions shall be assessed by the point-rating letter system for assessing educational achievements, in accordance with Annex 2 to these Rules.

      23. Final controls shall be carried out by teachers with a qualification corresponding to this discipline, upon completion of the study of sections of the curriculum in accordance with the schedule approved by the deputy head of the education organization of the Ministry of Internal Affairs in charge of educational work.

      A comprehensive exam shall be conducted by an examination committee, the composition of which shall be approved by the order of the head of the education organization of the Ministry of Internal Affairs. The composition of the examination commissions shall be formed from the number of employees of the territorial internal affairs bodies (according to the relevant categories of training), the teaching staff of the educational organization, representatives of the internal security units, and the Council of Veterans of the Internal Affairs Directorate.

      24. A student who has received an “unsatisfactory” mark on the final controls shall be allowed to retest. The retest shall be carried out once.

      Students who receive a second "unsatisfactory" mark based on the retest are subject to expel for failure to meet the requirements of the curriculum.

      25. Students who have successfully passed the final exams shall be issued a certificate with an attachment on the completion of initial vocational training in accordance with Annex 3 to these Rules, which shall be attached to the personal file.

      26. The organization of education of the Ministry of Internal Affairs, after the completion of initial vocational training, within ten working days, shall send to the personnel service of the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments a report with information on the results of initial vocational training form in accordance with Annex 4 to these Rules and shall send the personal files of the students.

      27. The period of initial vocational training shall be included in the length of service in the police department (length of service).

      28. Departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs and its departments, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments, in the direction of which the student underwent initial professional training shall:

      1) enroll in the staff of persons who have completed initial vocational training;

      2) terminate the employment contract with the trainee in accordance with labor legislation and pay compensation for unused labor leave.

      Appointment to the position shall be made within a month from the date of enrollment in the personnel of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs and its departments, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments.

Chapter 5. Grounds for expelling from initial vocational training

      29. Trainees shall be expelled from initial vocational training on the following grounds:

      1) for poor progress, expressed in failure to pass final controls or for failure to fulfill the curriculum;

      2) for violation of discipline provided for by the Charter of the educational organization of the Ministry of Internal Affairs and the Internal Regulations of the Organization of Education of the Ministry of Internal Affairs:

      3) at their request;

      4) a negative result of a special inspection by the national security agencies.

      A copy of the order of the head of the education organization of the Ministry of Internal Affairs on the expel of the student from the initial vocational training within two working days shall be sent to the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs and its departments, state institutions under the jurisdiction of the Ministry of Internal Affairs and its departments.

      The personnel service of the departments of the Ministry of Internal Affairs, territorial bodies under the jurisdiction of the Ministry of Internal Affairs, state institutions under the jurisdiction of the Ministry of Internal Affairs, and its departments terminate the employment contract with the student and pay compensation for unused leave.

      30. Expel of the student under subparagraphs 1) and 2) of paragraph 1 shall be carried out based on the conclusion of an official investigation, within a month from the date of the discovery of the misconduct.

      31. In case of refusal of a person who completed initial vocational training, from further service in the internal affairs bodies or expelling from the educational organization of the Ministry of Internal Affairs due to academic failure and (or) violation of discipline, as well as voluntarily, he is obliged to reimburse the state budget funds spent for preparation, food, and accommodation during the period of its preparation, in accordance with the current legislation of the Republic of Kazakhstan.

      This obligation shall not apply to an employee in the event of his dismissal from service within three years for health reasons based on the conclusion of the military-medical commission on the unsuitability or limited aptitude for service, or in connection with the staff reduction, reorganization, or liquidation of the internal affairs body in cases of inability to use in another position, as well as his transfer to another law enforcement body or a special state body.

      3) recover for the damage caused by the student to the property of the educational organization of the Ministry of Internal Affairs;

      4) collect budget funds spent on training, food, and accommodation during the period of study;

      3. The organization of education of the Ministry of Internal Affairs is obliged to:

      1) provide the student with the conditions for obtaining education in accordance with the Law of the Republic of Kazakhstan "On Education" and the requirements of regulatory legal acts of the Ministry of Internal Affairs of the Republic of Kazakhstan; 

      2) create learning conditions;

      3) provide the student with medical care (first aid, qualified medical care within the GPFM (guaranteed package of free medical care));

      4) submit to the state archives documents confirming the periods of study of the student;

      5) ensure the storage of a military ID (certificate of registration), as well as a work record book and making the necessary entries in it;

      6) attach to the student's personal file a certificate of the costs of his training;

      7) send the student for an internship in the territorial divisions of the internal affairs bodies during the period of initial vocational training.

      4. The student has the right to:

      1) modify and terminate this contract;

      2) on the conditions of education, living and medical support that meet the requirements of safety and hygiene.

      5. The student is obliged to:

      1) conscientiously master all types of educational and professional activities in the curriculum;

      2) observe official discipline;

      3) treat with care the property of the educational organization;

      4) comply with the requirements of the rules for labor protection, fire safety, and sanitary and hygienic standards;

      5) not to disclose information entrusted to him in accordance with his official position, which constitutes an official and other secrets protected by law;

      6) report on the situation that has arisen that poses a threat to the life and health of people, the safety of the property of the educational organization and students;

      7) in cases of changes in marital status, bringing him/her or his/her close relatives to criminal liability, leaving one of them for permanent residence abroad, report this by a report to the immediate superior within three days;

      8) after completing the initial vocational training, arrive at the duty station within five working days;

      9) serve in the relevant department of the internal affairs bodies of the Republic of Kazakhstan for at least three years;

      10) in cases of expelling due to academic failure, violation of discipline, self-will, refusal to serve in the internal affairs bodies before the expiration of this contract, reimburse the state budgetary funds spent on training, food and accommodation during the period of its preparation. The amount to be withheld shall be calculated for the full course of study.

      6. The contract shall be terminated by agreement of the parties or the initiative of one of the parties, as well as in case of violation of the terms of the Contract.

      7. The terms of this Contract may be changed and supplemented by the mutual written agreement of the parties.

      8. The contract shall be drawn up in 2 copies, one of which shall be kept in the personal file of the student.

      9. The Contract shall be valid until the Parties fully fulfill their obligations under this Contract.

      10. Disputes between the parties to this contract arising from the execution of its terms shall be resolved in the manner prescribed by the legislation of the Republic of Kazakhstan.

      11. For non-fulfillment and improper fulfillment of the obligations stipulated by this contract, the parties are liable in accordance with the legislation of the Republic of Kazakhstan.

      Footnote. The Rules supplemented by Annex 1-1 in accordance with the Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated October 21, 2020, No. 726 (shall come into effect upon expiry of ten calendar days after the day of its first official publication).

      Description of filling

      Form (description) of the certificate of initial vocational training in educational institutions of the Ministry of Internal Affairs of the Republic of Kazakhstan.

      1. The certificate is a document confirming the completion of initial vocational training in educational institutions of the Ministry of Internal Affairs of the Republic of Kazakhstan.

      2. The certificate shall consist of an A4 cover (size 297x210) mm made of glossy paper.

      3. The front side of the certificate shall be filled out in the state language:

      1) the background shall be light blue with the emblem of the Ministry of Internal Affairs of the Republic of Kazakhstan with a diameter of 110 mm, located in the center;

      2) at a distance of 7 mm from the edge, a dark blue ornamental frame, 7 mm wide.

      4. At the top of the document:

      1) in the center, at a distance of 2 mm from the edge of the ornamental frame, there shall be an image of the coat of arms of the Republic of Kazakhstan (the inscription Kazakhstan in Latin letters) with a diameter of 30 mm;

      2) under the image of the coat of arms in the center at a distance of 10 mm, the text is an empty column under the requisites "Name of the educational organization". It shall be printed in capital letters, bold Times New Roman 14;

      3) under the requisites "Name of the educational organization" at a distance of 15 mm the inscription "CERTIFICATE". It shall be printed in capital letters, bold Times New Roman 48.

      5. 15 mm below the inscription "CERTIFICATE" there shall be 6 lines:

      the first line - an empty column for the requisites "title, surname, name, patronymic (if any)";

      the second line - an empty column for the details "period of training";

      the third line is an empty column for the requisites " theme of the course ";

      the fourth line - the text “passed the first vocational training courses in the category”;
