      In accordance with subparagraph 40) of paragraph 1 of Article 9 of the Law of the Republic of Kazakhstan dated July 9, 2004 "On the protection, reproduction and use of the animal world" I HEREBY ORDER:

      1. To approve the attached Rules for the accreditation of republican associations of public associations of hunters and entities of hunting, as well as public associations of fishermen and entities of the fishing industry, and their accreditation.

      2. The Committee for Forestry and Wildlife of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan, in the manner prescribed by law, shall ensure:

      1) state registration of this Order with the Ministry of Justice of the Republic of Kazakhstan;

      2) posting this Order on the Internet resource of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan after its official publication;

      3) within ten working days after the state registration of this Order, the submission to the Department of Legal Service of the Ministry of Ecology, Geology and Natural Resources of the Republic of Kazakhstan information on the implementation of the measures provided for in subparagraphs 1) and 2) of this paragraph.

      3. Control over the implementation of this Order shall be entrusted to the supervising Vice-Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan.

      4. This Order shall come into effect upon the expiration of twenty one calendar days after the day of its first official publication.

Rules for accreditation of republican associations of public associations of hunters and entities of hunting, as well as public associations of fishermen and entities of fishing industry, their accreditation

Chapter 1. General Provisions

      1. These Rules for accreditation of republican associations of public associations of hunters and entities of hunting, as well as public associations of fishermen and entities of the fishing industry, their accreditation (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 40) of paragraph 1 of Article 9 of the Law of the Republic of Kazakhstan dated July 9 2004 "On the protection, reproduction and use of wildlife" (hereinafter referred to as the Law) and shall determine the procedure for organizing and conducting accreditation of republican associations of public associations of hunters and hunting entities, as well as public associations of fishermen and fishing entities, and their accreditation.

      2. The following basic concepts shall be used in these Rules:

      1) accreditation - the procedure for the official recognition of the competence of the subject of accreditation, to carry out the types of activities established by the Law;

      2) subject of accreditation - republican associations of public associations of hunters and entities of hunting, as well as public associations of fishermen and entities of the fishing industry (hereinafter referred to as the Association);

      3) hunting minimum (hereinafter referred to as the hunt minimum) - a special short course training program, considering the issues of legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife for hunting safety, knowledge of which is a prerequisite for the issuance of issuing a hunter's certificate;

      4) commission - for accreditation, a commission created in the department of an authorized state body in the field of protection, reproduction and use of wildlife;

      5) authorized body - an authorized state body in the field of protection, reproduction and use of wildlife.

      3. Accreditation shall be carried out by an authorized body to confirm the competence of the subject for accreditation to carry out the types of activities provided for in Article 33-1 of the Law.

      4. Procedure for accreditation:

      1) publication of the announcement of the accreditation;

      2) submission by associations to the authorized body of the documents specified in paragraph 7 of these Rules;

      3) consideration of accreditation materials by the commission;

      4) making a decision on accreditation or refusal of accreditation;

      5) issuance of a certificate of accreditation or a reasoned refusal to issue it.

Chapter 2. Procedure for conducting accreditation

      5. Announcement on the dates and conditions of accreditation in the Kazakh and Russian languages shall be posted on the Internet resource of the authorized body.

      6. In order to conduct accreditation, a commission shall be created, the composition of which shall be formed from among the employees of the authorized body.

      The composition of the commission shall be approved by the order of the head of the authorized body, in his absence - by the person acting as him/her.

      The total number of commission members shall be an odd number of employees of the authorized body, but not less than five people.

      The chairperson of the commission shall be the head of the authorized body, in his absence - the person acting as him/her.

      The secretary of the commission shall be appointed from among the employees of the authorized body and shall not be a member of the commission. The secretary of the commission shall organize the work of the commission; prepare the meetings of the commission and other functions within his competence.

      The decision on accreditation or refusal of accreditation shall be made by the commission by a majority vote by open vote, and the decision is drawn up in a protocol.

      In case of disagreement with the adopted decision, the members of the Commission shall state their opinion in writing, with attachment to the minutes of the meeting.

      7. To obtain the public service, the legal entity (hereinafter referred to as the service recipient) shall provide the following documents through the "electronic government" web portal www.egov.kz (hereinafter referred to as the Portal):

      when accrediting, the Association of Public Associations of Hunters and Hunting Entities shall file:

      1) an application in accordance with the form of Appendix 1 to these Rules;

      2) electronic copies of documents confirming the presence of:

      equipped premises on the ownership right and (or) other legal grounds for conducting a theoretical course under the hunting minimum program;

      website;

      branches and (or) representative offices (if any);

      special literature on protection of reproduction and use of the animal world, guides, manuals and exhibits on hunting minimum;

      the relevant staff with professional education in the field of protection, reproduction and use of wildlife;

      public associations of amateur hunters in the association.

      3) information form for the republican associations of public associations of hunters and hunting entities, in accordance with the form of Appendix 2 to these Rules.

      when accrediting, the association of public associations of fishermen and fishing entities shall file:

      1) an application in accordance with the form of Appendix 1 to these Rules;

      2) electronic copies of documents confirming the presence of:

      branches and (or) representative offices (if any);

      website;

      special literature in protection, reproduction and use of wildlife, guides and manuals on fisheries;

      the relevant staff with professional education in the protection, reproduction and use of wildlife;

      public associations of amateur fishermen and sport fishing in the association;

      3) the information form for the republican associations of public associations of fishermen and fishing entities, in accordance with the form of Appendix 3 to these Rules.

      The service provider shall retrieve information about the state registration (re-registration) of a legal entity from the relevant state information systems through the e-government gateway.

      When the service recipient files all the required documents through the Portal - through the "personal account" of the Service Recipient, the status of acceptance of the requested public service is displayed, indicating the date of receipt of the rendered Public Service result.

      The list of main requirements for the provision of the Public Service, including characteristics of the process, the form, content and result of the provision, as well as other information, taking into account the Public Service rendering specifics, are given in the standard of the public service "Accreditation of republican associations of public associations of hunters and hunting entities, as well as public associations of fishermen and fishing entities” in accordance with Appendix 7 to these Rules.

      8. On the day of the documents delivery, a clerk of the Service Provider's office shall accept, register and submit them for consideration to the executive in charge.

      Within 2 (two) business days from the date of the Service Receiver's application registration, the executive in charge shall check the completeness and validity of the submitted documents.

      When the Service Receiver submits all the necessary documents through the Portal, the Service Receiver's "personal account" displays the status of acceptance of the request for the Public Service, indicating the date of receipt of the Public Service result.

      If the Service Receiver submits an incomplete package of documents and (or) information necessary for the provision of the Public Service in accordance with these Rules, the Service Provider’s executive in charge shall send a notification to the Service Receiver within 2 (two) working days indicating the requirements that the package of documents and (or) information does not correspond to, according to the form of Appendix 8 to these Rules.

      If, within 2 (two) working days from the date of the notification receipt, the Service Receiver has not sent the package of documents and (or) information in accordance with the requirements, the Service Provider shall send to the “personal account” of the Service Receiver a reasoned refusal to further consider the application.

      If the Service Receiver submits a complete package of documents and there are no expired documents, the Service Provider shall examine them for compliance with the requirements of these Rules.

      9. The documents are considered at a meeting of the commission within 5 (five) working days, upon the results of which the commission shall make the following decision:

      1) to accredit the association;

      2) to deny accreditation.

      10. The authorized body, within five working days from the date of the decision of the commission, shall issue a certificate of accreditation or send a reasoned refusal.

      11. The authorized body shall refuse to issue accreditation on the grounds stipulated by subparagraphs 1), 2), 3) and 5) of paragraph 2 of Article 19-1 of the Law of the Republic of Kazakhstan dated April 15, 2013 “On public services”.

      12. A certificate of accreditation of republican associations of public associations of hunters and entities of hunting shall be issued for a period of four years in the form, in accordance with Annex 4 to these Rules.

      A certificate of accreditation of republican associations of public associations of fishermen and fishing entities shall be issued for a period of four years in the form in accordance with Annex 5 to these Rules.

      13. A certificate of accreditation shall be inalienable and may not be transferred to third parties.

      14. In cases of a change in the name and (or) legal address, the association, within five working days from the date of the change, shall submit an application for renewal of the accreditation certificate to the authorized body in the form in accordance with Annex 6 to these Rules.

      15. The decision on accreditation or refusal of accreditation of the association shall be appealed in the manner prescribed by the legislation of the Republic of Kazakhstan.

      16. A certificate of accreditation shall be terminated in the following cases:

      1) the expiration of its validity period;

      2) reorganization or liquidation of the association;

      3) submission by the association of an application for voluntary termination of the certificate;

      4) identification by the authorized body of the facts of improper performance of activities, provided for in Article 33-1 of the Law.

      17. Suspension, renewal, revocation (revocation) of the certificate of accreditation shall be carried out in the manner and (or) on the grounds provided for by Article 45 of the Law of the Republic of Kazakhstan dated May 16, 2014 "On Permits and Notifications".

Chapter 3. The procedure for appealing the accreditation results of republican associations of public associations of hunters and hunting entities, as well as public associations of fishermen and fishing industry entities

      18. A complaint against a decision, actions (inaction) of the Service Provider’s employees shall be filed in the name of the Head of the Service Provider and (or) to the authorized body for assessing and monitoring the public services quality in accordance with the Administrative Procedural and Process-Related Code of the Republic of Kazakhstan and the Law “On Public Services” (hereinafter referred to as the Law on Public Services).

      The complaint of the Service Receiver, received by the Service Provider, in accordance with paragraph 2 of Article 25 of the Law on Public Services is subject to consideration within 5 (five) working days from the date of its registration.

      The complaint of the Service Receiver, received by the authorized body for assessing and monitoring the public services rendering quality, in accordance with paragraph 2 of Article 25 of the Law on Public Services, is subject to consideration within 15 (fifteen) working days from the date of its registration.

      19. In cases of disagreement with the Service Provider’s decision, the Service Receiver shall apply to the court in accordance with subparagraph 6) of Article 4 of the Law on Public Services.
