On approval of risk assessment criteria and checklists in the field of seed production

      In accordance with subparagraph 2) of paragraph 2 of Article 86, paragraph 1 of Article 143 of the Entrepreneurial Code of the Republic of Kazakhstan of October 29, 2015, we hereby ORDER:

      1. To approve:

      1) criteria for assessing the degree of risk in the field of seed production in accordance with Appendix 1 to this joint order;

      2) seed checklists for:

      original seed producers according to Appendix 2 to this joint order;

      elite seed-production farms according to Appendix 3 to this joint order;

      seed-production farms according to Appendix 4 to this joint order;

      seed distributors according to Appendix 5 to this joint order;

      laboratories for the examination of seed quality according to Appendix 6 to this joint order;

      consumers of seeds (except for individuals engaged in seed production for use in home gardening, garden, country and kitchen-garden plots without the right to sell them) according to Appendix 7 to this joint order.

      2. The joint order No. 15-05 / 1137 of the Minister of Agriculture of the Republic of Kazakhstan dated December 28, 2015 and No. 822 of the Minister of National Economy of the Republic of Kazakhstan dated December 29, 2015 "On Approval of the Checklist in the Field of Seed Production" (registered in the Register of State Registration of Regulatory Legal Acts under the number 12750, published in the information-legal system "Adilet" on January 20, 2016).

      3. In accordance with the procedure established by law, the Crop Production and Processing Department of the Ministry of Agriculture of the Republic of Kazakhstan, shall:

      1) ensure the state registration of this joint order with the Ministry of Justice of the Republic of Kazakhstan;

      2) within ten calendar days from the date of state registration of this joint order, send its copies both in Kazakh and Russian languages to the Republican State Enterprise on the Right of Economic Management of the Republican Center of Legal Information for official publication and inclusion into the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;

      3) within ten calendar days after the state registration of this joint order, send a copy of it for official publication in periodicals;

      4) place this joint order on the Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication;

      5) within ten working days after the state registration of this joint order, submit the information on the implementation of measures provided for in subparagraphs 1), 2), 3) and 4) of this paragraph to the Legal Department of the Ministry of Agriculture of the Republic of Kazakhstan.

      4. This joint order shall enter into force upon the expiry of ten calendar days after the day of its first official publication.

Risk assessment criteria in the field of seed production

Chapter 1. General Provisions

      1. These criteria for assessing the degree of risk in the field of seed production (hereinafter referred to as the Criteria) have been developed in accordance with paragraph 3 of Article 141 of the Entrepreneurial Code of the Republic of Kazakhstan of October 29, 2015 (hereinafter referred to as the Code) and with order No. 3 of the Acting Minister of National Economy of the Republic of Kazakhstan of 31 July 3, 2018 “On Approval of the Rules for Forming Governmental Risk Assessment Systems and Checklists Forms by the State Bodies” (registered in the Register of State Registration of Regulatory Legal Acts under No. 17371), for the classification of entities subject to control in the field of seed production to the degrees of risk and the selection of entities (facilities) during preventive control with a visit to the entity (facility) subject tocontrol.

      2. In these Criteria the following concepts shall be used:

      1) entities (facilities) subject to control - individuals and legal entities engaged in the production, harvesting, processing, storage, examination, sale, transportation and use of seeds;

      2) minor violation - violation of the requirements established by the regulatory legal acts in the field of seed production, in terms of incorrect documentation management in the field of seed production, as well as violations not related to gross and major violations;

      3) major violation - violation of the requirements established by regulatory legal acts in the field of seed production on the availability of arable land, developed seed crop rotations, varietal agricultural technology, qualified specialists, initial seed material, ensuring the safety of seed accounting materials, conducting a systematic survey of crops (plantings), territories, seed cleaning machines and mechanisms, warehouses for identifying quarantine facilities and carrying out measures to combat them, store testing averages, execution of documents about the quality of seeds, use seeds corresponding in terms of varietal and sowing qualities to the requirements of the legislation of the Republic of Kazakhstan on seed production for sowing, availability of a license agreement, as well as violation of the deadlines and completeness of reporting;

      4) gross violation - violation of the requirements established by the legislation of the Republic of Kazakhstan in the field of seed production, entailing administrative responsibility, as provided for in Article 402 of the Code of the Republic of Kazakhstan "On Administrative Offenses", non-compliance with the requirements for material and technical equipment, testing, selection samples, compliance with standards in the field of seed production during the examination of seed quality, availability of complaints and appeals, use of seeds of agricultural plants, for sowing (planting), obtained on the basis of genetic engineering (genetically modified), use of seeds of agricultural plants, for sowing (planting), infected with quarantine objects, misuse of subsidized seeds;

      5) risk - the probability of causing harm as a result of the activity of the entity subject to control to the legitimate interests of individuals and legal entities, the property interests of the state, taking into account the severity of its consequences, expressed in the form of production, sale and use of seeds that do not comply with the varietal and sowing qualities of the requirements of the legislation of the Republic of Kazakhstan, due to violation of the legislation on seed production;

      6) objective criteria for assessing the degree of risk (hereinafter referred to as the objective criteria) are the criteria for assessing the degree of risk used to select the entities (facilities) subject to control depending on the degree of risk in a certain field of activity and not directly dependent on the individual entity (facility) subject to control;

      7) subjective criteria for assessing the degree of risk (hereinafter – the subjective criteria) - criteria for assessing the degree of risk, used to select the entities (facilities) subject to control, depending on the performance of a particular entity (facility) subject to control;

      8) risk assessment criteria shall be a set of quantitative and qualitative indicators related to the direct activity of the entity (facility), features of sectoral development and factors influencing this development, allowing to refer entities to different degrees of risk;

      9) checklist shall be a list of requirements that includes only those requirements for the activities of entities (facilities) subject to control, the non-observance of which entails a threat to human life and health, the environment, the legitimate interests of individuals and legal entities, the state.

      3. The distribution of entities subject to control according to the risk degrees shall be carried out on the basis of objective and subjective criteria.

Chapter 2. Objective criteria

      4. Objective criteria have been developed in order to distribute entities (facilities) subject to control by degrees of risk (high and not classified as high).

      5. The risk assessment of the entities subject to control and their assignment to a high risk group shall be carried out according to objective criteria, based on the highest probability of causing harm to human life or health, the legitimate interests of individuals and legal entities, and the property interests of the state as a result of the activities of the entity subject to control, taking into account the severity of its consequences.

      6. Producers of original seeds, elite-seed farms, seed farms and laboratories for the examination of seed quality shall be classified as high risk.

      7. К Seed distributors and seed consumers (except for individuals engaged in seed production for use in home gardening, garden, country and kitchen-garden plots without the right to sell them) shall be classified as non-high risk.

      8. Subjective criteria shall be applied to entities (facilities) classified as high-risk, in order to carry out preventive control with a visit to the entity (facility)subject to control.

Chapter 3. Subjective criteria

      9. Subjective criteria have been developed on the basis of the requirements of the regulatory legal acts in the field of seed production listed in the checklists, which shall be divided into three degrees: gross, major , minor and shall be listed in the Appendix to these Criteria.

      10. The definition of subjective criteria shall be carried out using the following steps:

      1) formation of a database and collection of information;

      2) information analysis and risk assessment.

      11. The following sources of information shall be used to assess the degree of risk:

      1) the results of the analysis of previous inspections and preventive control with a visit to the entities (facilities) subject to control, at the same time, the severity of violations (gross, major , minor) shall be established in case of non-compliance with the law requirements, as reflected in the checklists;

      2) the results of monitoring reports and information provided by the entities subject to control, including through automated information systems conducted by government agencies, institutions and industry organizations;

      3) the presence and number of confirmed complaints.

      12. On the basis of the sources of information specified in paragraph 11 of these Criteria, subjective criteria shall be determined according to the Appendix to these Criteria.

      13. The proportion of not fulfilled Criteria shall be determined when calculating the risk degree indicator.

      One violation of a gross degree shall be equal to the indicator 100.

      If gross violations have not been revealed , then for the determination of the risk degree indicator, a total indicator shall be calculated for violations of a major and minor degree.

      A coefficient of 0.7 shall be applied when determining the indicator of significant violations, and this indicator shall be calculated using the following formula:

      When determining the indicator of minor violations, a coefficient of 0.3 shall be applied and this indicator shall be calculated using the following formula:

      The overall risk degree indicator

shall be calculated on a scale from 0 to 100 and determined by summing up the indicators of major and minor violations using the following formula:

      14. In terms of risk, the entity (facility) subject to control shall be classified as:

      1) high risk - with an indicator of the degree of risk from 61 to 100 inclusive, and prophylactic control shall be carried out in relation to it with a visit to the entity (facility) subject to control;

      2) non-high-risk category - with a risk index from 0 to 60 inclusively and with no preventive control in relation to it and with no visit to the entity (facility) subject to control.

Chapter 4. Final Provisions

      15. The multiplicity of preventive control with a visit to the entity (facility) subject to control may not be more than once a year.

      When analyzing and assessing the degree of risks, the data of subjective criteria previously taken into account and used in relation to a specific entity facility) or data on which the limitation period has expired in accordance with the legislation of the Republic of Kazakhstan shall not be applied.

      16. Preventive control with a visit to the entity (facility) subject to control shall be carried out on the basis of semi-annual lists of preventive control with a visit to the entity (facility) subject to control compiled in conjunction with paragraph 3 of Article 141 of the Code.

      17. Lists of preventive control with a visit to the entity (facility) subject to control shall be compiled taking into account the priority of the entity subject to control with the highest risk index by subjective criteria.
