      In accordance with subparagraph 43) of Article 5 of the Law of the Republic of Kazakhstan dated July 27, 2007 "On Education", subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "On Public Services" I HEREBY ORDER:

      1. To approve the Rules for placing a state educational order for the training of personnel with technical and professional, post-secondary, higher and postgraduate education, taking into account the needs of the labour market, for preparatory departments of organizations of higher and (or) postgraduate education, as well as for preschool education and training, secondary education and additional education of children.

      2. To invalidate some orders of the Minister of Education and Science of the Republic of Kazakhstan in accordance with the appendix to this order.

      3. In accordance with the procedure established by law, the Department of Higher and Postgraduate Education, International Cooperation (S.M.Omirbaev) shall:

      1) ensure state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;

      2) within ten calendar days of the state registration of this order, send its copy to print periodicals and the “Adilet” Legal Information System for official publication, and also to the Republican State Enterprise with the Right of Economic Management “Republican Center of Legal Information” of the Ministry of Justice of the Republic of Kazakhstan for its inclusion into the Reference Control Bank of Regulatory Legal Acts of the Republic of Kazakhstan;

      3) place these rules on the official website of the Ministry of Education and Science of the Republic of Kazakhstan;

      4) within ten working days of the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit information on the implementation of measures provided for in subparagraphs 1), 2) and 3) of paragraph 3 of this order to the Legal Department of the Ministry of Education and Science of the Republic of Kazakhstan.

      4. Control over execution of this order shall be entrusted to the supervising vice-minister of Education and Science of the Republic of Kazakhstan, T.O. Balykbayev.

      5. This order shall take effect ten calendar days after its first official publication.

Rules for placing a state educational order for the training of personnel with technical and professional, post-secondary, higher and postgraduate education, taking into account the needs of the labour market, for preparatory departments of organizations of higher and (or) postgraduate education, as well as for preschool education and training, secondary education and additional education of children

Chapter 1. General provisions

      1. These Rules have been developed in accordance with subparagraph 43) of Article 5 of the Law of the Republic of Kazakhstan "On Education" (hereinafter-the Law) and shall determine the placement of a state educational order for the training of personnel with technical and professional, post-secondary, higher and postgraduate education, taking into account the needs of the labour market, for preparatory departments of organizations of higher and (or) postgraduate education (hereinafter-OHPE), as well as for preschool education and training, secondary education and additional education of children.

      2. The state educational order for preschool education and training shall be placed in educational organizations, regardless of the form of ownership and departmental subordination, types and kinds.

      In the volume of the state educational order, the current costs of a preschool organization for education and training shall be reimbursed per child within the framework of the State general educational standard for preschool education and training, approved by the order of the Minister of Education and Science of the Republic of Kazakhstan dated October 31, 2018 No. 604 “On approval of state compulsory standards of education at all levels of education” (registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan under No. 17669).

      With per capita financing, the customer of the state educational order finances the volume of services for preschool education and training for children in the following cases:

      1) for children attending a preschool organization constantly, without absences;

      2) for children who were absent in a preschool organization for three working days;

      3) for children who were absent for reasons: illness, treatment, rehabilitation of the child in medical, sanatorium-resort and other organizations (upon presentation of a certificate), provision of one of the parents (legal representative of the child) with labour leave and rehabilitation of the child during the summer period for up to two months (if there is an application).

      For the period of restrictive measures, including quarantine, emergency situations of a social, natural and man-made nature, as a result of which children do not attend a preschool organization, the state educational order for preschool education and training shall be financed in the volume and amount determined by the decision of local executive bodies.

      3. The state educational order for secondary education shall be placed in state and private educational organizations in accordance with Chapter 5 of these Rules.

      4. The state educational order for the training of personnel with technical and vocational, post-secondary education (hereinafter - TVPSE) shall be placed in educational organizations implementing educational programs of technical and vocational, post-secondary education (hereinafter- organizations of TVPSE), regardless of the form of ownership and departmental subordination, taking into account the proposals of regional chambers of entrepreneurs and interested organizations.

      5. The state educational order for the training of personnel with TVPSE shall be placed based on the results of actual admission to educational organizations in which training is conducted according to educational programs that provide for the training of qualified workers, taking into account the design capabilities of the TVPSE organization, spiritual (religious) educational organizations, educational organizations in correctional institutions of the penitentiary system, as well as when enrolling students in special educational programs.

      6. Placement of a state educational order for training personnel in educational programs that provide for the training of mid-level specialists and applied bachelors shall be carried out on the basis of the distribution of applicants by specialties, qualifications and organizations of TVPSE, with the exception of organizations of TVPSE, specified in paragraph 5 of these Rules.

      7. The distribution of applicants by specialties, qualifications and organizations of TVPSE shall be carried out on a competitive basis in accordance with the Model rules for admission to study in educational organizations, implementing educational programs of technical and vocational, post-secondary education, approved by the order of the Minister of Education and Science of the Republic of Kazakhstan dated October 18, 2018 No. 578 (registered in the State register of regulatory legal acts No. 17705) (hereinafter - Order No. 578).

      In the organizations of TVPSE financed from the republican budget, the authorized bodies of the relevant sector (hereinafter- ABRS) shall place a state educational order for training personnel with TVPSE in specialties, taking into account the needs of the labour market on the basis of a resolution approved by the Government of the Republic of Kazakhstan for the relevant period in accordance with subparagraph 4) Article 4 of the Law of the Republic of Kazakhstan "On Education".

      8. The state educational order for the training of personnel with higher and postgraduate education, formed and distributed by groups of educational programs, taking into account the forecasted needs of the economy in personnel, including sectoral and regional needs, the priorities of industrial and innovative development of the country, the needs of organizations of higher and (or ) postgraduate education (hereinafter – higher educational institution) and scientific organizations in the scientific and pedagogical staff shall be placed among the higher educational institutions (hei(s) on a competitive basis.

      9. The state educational order for the training of personnel with higher education shall be placed in hei(s), regardless of the form of ownership, in the form of educational grants based on the results of a tender held by the authorized body in the field of education.

      10. The state educational order for the training of masters and doctors of philosophy (PhD)/doctors in the profile, including targeted training for regional OHPE and scientific organizations shall be placed on a competitive basis, regardless of the form of ownership in OHPE.

      11. The state educational order for training students at the preparatory departments shall be placed in hei(s) based on the results of a tender held by the authorized body in the field of education.

      12. The state educational order for additional education of children shall be placed in organizations, regardless of the form of ownership, implementing educational programs for additional education of children and included in the list for placement of a state educational order for additional education of children.

      In the scope of a state educational order for additional education of children, the following expenses shall be reimbursed for one child aged 3 to 18:

      1) wages of employees of an organization implementing educational programs for additional education of children in accordance with the resolution of the Government of the Republic of Kazakhstan dated December 31, 2015 No. 1193 “On the system of remuneration of civil servants, employees of organizations supported by the state budget, employees of state-owned enterprises.”;

      2) expenses for the maintenance and operation of the building (premises);

      3) expenses for professional development of teachers.

      For the period of restrictive measures, including quarantine, emergency situations of a social, natural and man-made nature, as a result of which children do not attend an organization, an organization, implementing an educational program for additional education of children, the state educational order for additional education of children shall be financed in the volume and amount, determined by the decision of local executive bodies.

      13. A child attends one section (circle) within the framework of the state educational order for additional education of children.

Chapter 2. Placement of the state educational order for preschool education and training

      14. To place a state educational order for preschool education and training, the education departments of cities of republican significance, the capital, education departments located in districts, cities shall recruit a contingent of children.

      When recruiting a contingent of children according to the state educational order, the education department of cities of republican significance, the capital, education departments located in districts, cities shall be guided by the priority list.

      15. Placement of a state educational order for preschool education and training shall be carried out by the education departments of cities of republican significance and the capital, education departments located in districts, cities, in the manner prescribed by paragraph 1 or paragraph 2 of this chapter.

      Placement of the state educational order for preschool education and training in the manner prescribed by paragraph 2 of this chapter shall be carried out in agreement with the authorized body in the field of education.

      16. The volume of the state educational order for preschool education and training shall be determined in accordance with the algorithm for calculating the per capita regulatory financing of preschool education and training, according to the Methodology for per capita regulatory financing of preschool education and training, secondary, technical and vocational, post-secondary education, as well as higher and postgraduate education taking into account the credit technology of education (hereinafter - the Methodology), approved by the order of the Minister of Education and Science of the Republic of Kazakhstan dated November 27, 2017 No. 597 (registered in the Register of state registration of regulatory legal acts under No. 16137). At the same time, per capita regulatory financing of preschool education and training shall be carried out in accordance with the Rules for per capita regulatory financing of preschool education and training, secondary, technical and vocational, post-secondary education, as well as higher and postgraduate education, taking into account the credit technology of education (hereinafter - the Rules for per capita regulatory financing), approved by the order of the Minister of Education and Science of the Republic of Kazakhstan dated November 27, 2017 No. 596 (registered in the Register of state registration of regulatory legal acts under No. 16138).

Paragraph 1. Placement of the state educational order for preschool education and training on a competitive basis

      17. To place a state educational order for preschool education and training, the education departments of cities of republican significance, the capital, education departments located in districts, cities shall hold a tender.

      To place a state educational order for preschool education and training, the education departments of cities of republican significance, the capital, education departments located in districts, cities shall place an announcement about the tender on their official Internet resources indicating the date, time and place of the tender, the duration of the tender – 15 (fifteen) working days.

      To place a state educational order for preschool education and training, local executive bodies of cities of republican significance, the capital, and regions shall create a Commission (hereinafter- the Commission).

      The commission shall be formed from among representatives of maslikhats, akimats, education departments of cities of republican significance, the capital, education departments located in districts, cities, non-governmental organizations and the regional chamber of entrepreneurs. The number of members of the Commission is odd. The Chairman of the Commission is the head of the education department of cities of republican significance, the capital, education departments located in districts, cities.

      18. Preschool organizations, regardless of the form of ownership shall be included in the list of providers of services for preschool education and training for placing a state educational order in them, subject to the norms and rules for the activities of preschool organizations provided for by the Model rules for the activities of preschool organizations, approved by the order of the Minister of Education and Science of the Republic of Kazakhstan dated October 30, 2018 No. 595 “On approval of the Model rules for the activities of educational organizations of the relevant types” (registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan under No. 17657).

      19. Preschool organizations that have notified the authorized body in the field of education about the start of their activities and have applied for a state educational order for preschool education and training shall be allowed to participate in the tender.

      To participate in the tender, private preschool organizations shall submit the following documents:

      1) an application addressed to the Chairman of the Commission in the form according to Appendix 1 to these Rules;

      2) a certificate or a copy of the certificate of state registration (re-registration) of a legal entity or an individual entrepreneur, the charter of a preschool organization, a certificate from a bank that there is no debt, a certificate from a tax authority that there is no debt with a date not earlier than one month before the submission of documents;

      3) a copy of title documents for real estate (own or leased) used for the organization of preschool education and training;

      4) a copy of the sanitary and epidemiological conclusion on the compliance of the preschool organization with sanitary and epidemiological requirements in accordance with the Rules for the provision of public services for the issuance of sanitary and epidemiological conclusions, approved by the order of the Minister of Healthcare of the Republic of Kazakhstan dated December 30, 2020 No. KR MHC-336/2020 "On some issues of providing public services in the field of sanitary and epidemiological welfare of the population” (registered in the Register of state registration of regulatory legal acts under No. 22004) (hereinafter - order No. KR MHC -336/2020);

      5) a copy of the license for a medical office or a service agreement with a polyclinic, taking into account the place of fixing;

      6) the obligations of the supplier to accept children under the state educational order for preschool education and training exclusively in the direction of the education departments of cities of republican significance, the capital, education departments located in districts, cities with an established amount of parental payment for food, in accordance with the Law. The Supplier fills out the obligation form in accordance with Appendix 2 to these Rules;

      7) copies of tutors' documents on state-standard education with pedagogical or vocational education.

      The documents specified in subparagraphs 1) - 7) of this paragraph shall be laced, numbered, signed by the founder of the preschool organization, certified with a seal and submitted in the manner specified in the announcement of the tender.

      If the preschool organization is a private enterprise, certification of documents with a seal shall not be required.

      20. The submitted applications, with the documents attached to them shall be considered by the Commission at a meeting within 5 (five) working days.

      After the meeting of the Commission, a protocol for preliminary admission to participation in the tender shall be drawn up, which is signed by the chairman of the Commission and members of the Commission, with the following information:

      1) a list of preschool organizations that do not meet the requirements of these Rules with a detailed description of the reasons for their rejection, including indicating information and documents confirming the non-compliance of documents;

      2) the date of re-consideration of documents submitted by preschool organizations with corrections and additions in accordance with the protocol for preliminary admission.

      The decision of the Commission on preliminary admission shall be posted by the secretary of the Commission within 3 (three) working days on the Internet resource of the education department of cities of republican significance, the capital, the education department located in the district, city.

      Potential suppliers shall bring the documents into conformity in accordance with the protocol for preliminary admission within 5 (five) working days from the date of placement of the protocol for preliminary admission.

      The Commission, within 3 (three) working days from the date of receipt, re-examines applications, with the documents attached to them, for participation in the tender of preschool organizations specified in the list of the protocol for preliminary admission to participation in the tender for completeness of bringing them into line.

      The commission shall make a decision on inclusion in the list of preschool organizations in which the state educational order for preschool education and training will be placed, indicating the number of places.

      The decision of the Commission indicating the maximum possible number of places for placing a state educational order for preschool education and training shall be drawn up in the form of a protocol within 3 (three) working days after the day of the meeting.

      The Commission shall make one of the following decisions:

      1) on inclusion in the list for placing a state educational order for preschool education and training in a private preschool organization;

      2) on the refusal to be included in the list for placing a state educational order for preschool education and training in a private preschool educational organization in case of non-compliance with paragraphs 18 and 19 of these Rules.

      20-1. In the event that the number of proposals from private preschool organizations exceeds the number of places under the state educational order for preschool education and training, the suppliers shall be selected by the Commission according to additional criteria on a competitive basis.

      20-2. Additional criteria for the competitive selection of suppliers shall be:

      1) the proportion of tutors of the highest and first categories is at least 10% of their total number;

      2) the proportion of tutors with professional education in the relevant profiles is at least 50% of their total number.

      By a majority vote of the members of the Commission by open voting, the decision is considered adopted. In case of equality of votes of the Commission members, the vote of the chairman of the Commission shall be decisive.

      The protocol shall be drawn up by the secretary, signed by the chairman and all members of the Commission who participated in the meeting. Meetings of the Commission shall be held as needed and considered valid if attended by more than half of the total number of its members.

      The decision to place a state educational order for preschool education and training shall be published on the Internet resources of the education departments of cities of republican significance, the capital, education departments located in districts, cities.

      Representatives of the education departments of cities of republican significance, the capital, education departments located in districts, cities shall monitor once a year the activities of preschool organizations on the fulfilment of obligations, stipulated by the contract for placing a

      state educational order for preschool education and training and provide advisory assistance.

      Preschool organizations with previously placed places under the state educational order for preschool education and training shall be included in the protocol of the meeting without passing the tender, subject to the submission of an application and documents provided for in subparagraph 7) of paragraph 19 of these Rules.

      20-3. Placement of a state educational order for preschool education and training for new and additional places, as well as for the places of branches of preschool organizations with previously placed places under the state educational order for preschool education and training shall be carried out on a competitive basis.

Paragraph 2. Placement of a state educational order for preschool education and training, taking into account personalized financing for the recipients of educational services

      20-4. To place a state educational order for preschool education and training, taking into account personalized financing for the recipients of educational services, the education department of cities of republican significance, the capital, education departments located in districts, cities shall post on their Internet-resource information on accepting applications from preschool organizations for inclusion in the List of potential providers of services for preschool education and training, taking into account personalized financing for recipients of educational services (hereinafter - the List), formed by the education department of cities of republican significance, the capital, education departments located in districts, cities, without holding a tender and regardless of the formed contingent of children, in accordance with paragraph 14 of these Rules.

      Education departments of cities of republican significance, the capital, education departments located in districts, cities, which have posted on their official Internet resource information on accepting applications from preschool organizations for inclusion in the List, shall ensure the continuous formation of the List, through the constant availability of this information on their official Internet -resource.

      20-5. For inclusion in the List, preschool organizations shall submit to the education department of cities of republican significance, the capital, the department of education located in the district, city, applications in the form of an electronic document certified by the electronic digital signature of the head, and if preschool organizations do not have the opportunity to submit applications in the form of an electronic document, applications shall be provided on paper, signed by the heads of preschool organizations, in the form, according to Appendix 22 to these Rules, with the following documents attached:

      1) a certificate or a copy of the certificate of state registration (re-registration) of a legal entity or individual entrepreneur;

      2) copies of title documents for real estate (own or rented) used to accommodate a preschool organization;

      3) a copy of the contract for the provision of medical assistance (medical care), concluded between the preschool organization and the organization of primary healthcare at the place of attachment of the pupils of preschool organization, provided or a copy of the license for medical activities.

      It is not required to attach the documents provided for in subparagraphs 1) - 3) of this paragraph of the Rules for state preschool organizations.

      20-6. The education department of cities of republican significance, the capital, the education department located in the district, city, shall consider applications from preschool organizations with attached documents within 5 (five) working days from the date of their receipt.

      Considering the applications of preschool organizations with attached documents, the education department of cities of republican significance, the capital, the department of education located in the district, city shall check the completeness of the submitted documents, as well as whether preschool organizations have valid notices of the start of activities in the field of preschool education and (or) licenses for medical activities (if there is a medical centre) by obtaining information from state electronic information resources.

      The results of consideration of applications of preschool organizations with attached documents shall be drawn up in a protocol, which indicates one of the following decisions:

      1) on inclusion of a preschool organization in the List;

      2) on refusal to be included in the List, in case of submission of an application and (or) documents attached to it not complying with paragraph 20-5 of these Rules. The refusal to include a preschool organization in the List does not prevent the preschool organization from resubmitting a new application with the attached documents.

      The protocol shall be posted within 3 (three) working days on the official Internet resource of the education department of cities of republican significance, the capital, by education departments located in districts, cities.

      20-7. The generated List indicates the name of a preschool organization, its design capacity, the number of vacancies at the time of application and contact details.

      The department of education of cities of republican significance, the capital, the department of education located in the district, city shall ensure the constant availability of the formed List on its official Internet resource, taking into account all the changes and (or) additions made to it.

      20-8. The basis for the exclusion of preschool organizations from the List shall be the detection by the education department of cities of republican significance, the capital, the education department located in the district, city of the facts of violation of obligations assumed upon application, in accordance with Appendix 22 to these Rules by preschool organizations in the process of providing services for preschool education and training.

      The department of education of cities of republican significance, the capital, the department of education located in the district, city, within 5 (five) working days from the date of detection of the abovementioned facts shall send a notification to the preschool organization to eliminate the detected violations. Preschool organizations within 10 (ten) working days from the date of receipt of the notification shall take measures to eliminate the detected violations and notify the education department of cities of republican significance, the capital, the education department located in the district, city of the results.

      If the preschool organization does not eliminate the detected violations within the period established in this paragraph of the Rules, the department of education of cities of republican significance, the capital, the education department located in the district, city, within 5 (five) working days shall take a decision in agreement with the relevant regional chamber of the National Chamber of entrepreneurs of the Republic of Kazakhstan to exclude a preschool organization from the List, which shall be posted within 3 (three) working days on the official Internet resource of the education department of cities of republican significance, the capital, the education department, located in the district, city, and also within 3 (three ) working days shall notify the second-tier bank and (or) the National postal operator, with which the framework agreement has been concluded, in accordance with subparagraph 1) of paragraph 20-10 of these Rules.

      Preschool organizations shall be subject to inclusion in the List if there is an appropriate court decision issued at the suit of a preschool organization that was excluded from the List in violation of the requirements of this paragraph of the Rules.

      The exclusion of a preschool organization from the List does not prevent the re-inclusion of this preschool organization in the List in the manner prescribed by paragraph 20-5 of these Rules. At the same time, the re-inclusion of a preschool organization in the List shall be subject to the expiration of twenty-four months from the date of exclusion of a preschool organization from the List.

      20-9. Determination of preschool organizations for placement in them of a state educational order for preschool education and training, taking into account personalized funding for recipients of educational services shall be carried out by parents or other legal representatives of children included in the formed contingent, in accordance with paragraph 14 of these Rules.

      The result of determining a preschool organization for placement in it of a state educational order for preschool education and training, taking into account personalized funding for recipients of educational services shall be an agreement for the provision of educational services for preschool education and training, concluded between parents or other legal representatives of children and a preschool organization.

      20-10. Placement of the state educational order for preschool education and training, taking into account personalized financing for recipients of educational services shall be carried out through the following sequential actions:

      1) opening of bank accounts by parents or other legal representatives of children included in the formed contingent, in accordance with paragraph 14 of these Rules, in the name of children or in their name for the purpose of placing a state educational order for preschool education and training, taking into account personalized financing for recipients of educational services, providing direct return of unused budgetary funds at the end of the financial year, in accordance with subparagraph 4) of this paragraph of the Rules. The opening of bank accounts specified in this subparagraph shall be carried out in a second-tier bank and (or) the National postal operator, which has concluded a framework agreement with the education department of cities of republican significance, the capital, the education department located in the district, city, according to which the second-tier bank and (or) the National postal operator guarantees compliance with the targeted purpose of budget funds transferred to the bank accounts of children or their parents or other legal representatives, and intended for subsequent non-cash transfer to preschool organizations for the educational services they provide for preschool education and training for relevant children as part of placement of the state educational order for preschool education and training, taking into account personalized funding for the recipients of educational services;

      2) conclusion between parents or other legal representatives of children included in the formed contingent, in accordance with paragraph 14 of these Rules, and preschool organizations included in the List, an agreement for the provision of educational services for preschool education and training;

      3) monthly transfer of budgetary funds to the bank accounts specified in subparagraph 1) of this paragraph of the Rules by the education department of cities of republican significance, the capital, the education department located in the district, city;

      4) non-cash transfer from the bank accounts specified in subparagraph 1) of this paragraph of the Rules to the accounts of the relevant preschool organizations included in the List of budgetary funds within the framework of the state educational order for preschool education and training, taking into account personalized financing for recipients of educational services in accordance with the conditions of the relevant contracts for the provision of educational services for preschool education and training. The transfer of budgetary funds from the bank account specified in subparagraph 1) of this paragraph of the Rules, opened in the name or in the interests of one child, to the account of a preschool organization in order to pay for educational services for preschool education and training for another child shall not be allowed.

      Budgetary funds remaining unused as of January 1 of the financial year in the bank accounts specified in subparagraph 1) of this paragraph of the Rules shall be subject to direct return to the relevant local budget within 5 (five) working days.

      20-11. Preschool organizations that place a state educational order for preschool education and training, taking into account personalized funding for recipients of educational services monthly fill in information about their pupils, including those included in the formed contingent, in accordance with paragraph 14 of these Rules in the National educational database.

      20-12. Monitoring of the quality and (or) volume of educational services provided within the framework of the placed state educational order for preschool education and training, taking into account personalized financing for recipients of educational services shall be carried out by the parties to the contract for the provision of educational services for preschool education and training.

Chapter 3. Placement of a state educational order in the organization of technical and vocational, post-secondary education

      21. Local executive bodies of the region, city of republican significance, the capital (hereinafter - LEB) shall place a state educational order for the training of personnel with technical and vocational, post-secondary education, taking into account the needs of the labour market.

      21-1. The volume of the state educational order for the training of personnel with technical and vocational, post-secondary education shall be determined in accordance with the algorithm for calculating the per capita normative financing of technical and vocational, post-secondary education, according to the Methodology. At the same time, per capita normative financing of technical and vocational, post-secondary education shall be carried out in accordance with the Rules for per capita normative financing.

      22. In order to place a state educational order for training personnel with TVPSE, Commission for placing a state educational order for training personnel with TVPSE (hereinafter-the Commission) shall be created, the members of which shall be approved by the local executive body or by order of the ABRS. The Commission is a permanent consultative and advisory body.

      23. The Commission includes the representatives of local representative and executive bodies, the Department for quality assurance in the sphere of education and science, the Regional chamber of entrepreneurs, business entities, public organizations. The chairman of the Commission is the deputy akim of the region, the city of republican significance and the capital, who is in charge of education, or a person acting his/her duties.

      The Commission of the ABRS includes employees of the ABRS, the authorized body in the field of education, representatives of civil society institutions, the National Chamber of Entrepreneurs of the Republic of Kazakhstan "Atameken", industry associations. The Chairman of the Commission is the first head of the ABRS, or a person substituting him/her.

      24. Meetings of the Commission shall be held according to the plan approved by its chairman and considered valid if they are attended by more than 2/3 of the total number of its members.

      Unscheduled meetings of the Commission shall be held in cases of vacant seats or controversial issues when placing a state educational order.

      The decision of the Commission shall be adopted by open voting by a majority of votes of members of the Commission present at the meeting and shall be drawn up in the protocol of the meeting, which is signed by the chairman of the Commission. In case of equality of votes of members of the Commission, the vote of the chairman of the Commission shall be decisive. The protocol shall also be signed by the members of the Commission.

      Audio or video recordings shall be made at the meetings of the Commission. The audio video shall be stored in the archive for at least three years.

      25. The Commission shall determine the list of TVPSE organizations that meet the requirements of the authorized body in the field of education for the TVPSE organization specified in paragraph 32 of these Rules, in which the state educational order is placed.

      26. In order to determine TVPSE organizations, in which, under the terms of the tender, a state educational order is placed for training personnel with TVPSE, the educational bodies of the region, city of republican significance and the capital shall annually announce a tender among TVPSE organizations on official Internet resources.

      27. To participate in the tender for placing a state educational order for training personnel with TVPSE, the service recipients shall provide the service provider with a package of documents specified in the state service Standard "Acceptance of documents for the tender on the placement of a state educational order for the training of personnel with technical and vocational, post-secondary education" (hereinafter-the Standard) in accordance with Appendix 3 to these Rules through the State corporation or through the "electronic government" web portal (hereinafter-the portal).

      The list of basic requirements for the provision of public services, including the characteristics of the process, the form, content and result of rendering services, as well as other information, taking into account the specifics of provision of a public service is given in the Standard.

      28. An employee of the State corporation registers documents and issues a receipt to the service recipient on acceptance of a package of documents or, if the service recipient provides an incomplete package of documents, refuses to accept documents and issues a receipt in accordance with Appendix 4 to these Rules.

      In case of applying through the State corporation, the day of admission is not included in the term for the provision of a public service.

      In case of submitting documents through the Portal, the service recipient's "personal account" displays information on the status of consideration of a request for the provision of a public service, as well as a notification indicating the date and time of receipt of the result of the public service.

      29. On the day of receipt, the service provider's office shall carry out registration of the application and send it for execution to the responsible structural unit. If an application is received after the end of working hours, on weekends and holidays in accordance with the labour legislation of the Republic of Kazakhstan, the application shall be registered on the next working day.

      1) An employee of the responsible structural unit of the service provider, within 2 (two) working days from the date of receipt, shall check the completeness of the submitted documents.

      In the event that the service recipient submits an incomplete package of documents and (or) submit expired documents, an employee of the responsible structural unit of the service provider shall send a reasoned refusal to further consider the application on paper or if the documents are submitted through the Portal to the "personal account" of the service recipient in the form of an electronic document certified by the EDS of the authorized person of the service provider.

      2) When the service recipient submits a complete package of documents, an employee of the responsible structural unit of the service provider shall send the service recipient a notification of acceptance of documents for a tender on the placement of a state educational order for training personnel with technical, vocational and post-secondary education in educational organizations in any form.

      The service provider shall ensure the delivery of documents to the branch of the State corporation no later than one day before the expiration of a public service.

      30. The service provider shall ensure, that information about the stage of rendering a public service is entered into the information system for monitoring the provision of public services in the manner established by the authorized body in the field of informatization, in accordance with subparagraph 11) of paragraph 2 of Article 5 of the Law of the Republic of Kazakhstan "On Public Services".

      31. A complaint against the decision, actions (inaction) of the service provider on the issues of rendering public services may be filed in the name of the head of the service provider, to the authorized body for assessing and monitoring the quality of public services provision, in accordance with the legislation of the Republic of Kazakhstan.

      The complaint of the service recipient received by the service provider, in accordance with subparagraph 2) of Article 25 of the Law of the Republic of Kazakhstan "On Public Services", shall be subject to consideration within 5 (five) working days from the date of its registration.

      The complaint of the service recipient received by the authorized body for assessing and monitoring the quality of public services provision shall be subject to consideration within 15 (fifteen) working days from the date of its registration.

      In cases of disagreement with the results of rendering a public service, the service recipient shall apply to the court in accordance with the procedure established by the legislation of the Republic of Kazakhstan.

      32. When determining organizations of TVPSE, the Commission shall be guided by the following main criteria, as well as information confirming the fulfillment of requirements of the authorized body in the field of education for a TVPSE organization to place a state educational order for training personnel with TVPSE in accordance with Appendix 5 to these Rules:

      1) availability of a license for the right to conduct educational activities on educational programs of TVPSE in the declared specialties, taking into account the profile of training (with the exception of TVPSE organizations located in rural areas, in correctional institutions of the penitentiary system) in accordance with paragraph 3 of Appendix 1 to the Law of the Republic of Kazakhstan "On Permits and Notifications";

      2) availability of appropriate training and production workshops, halls, laboratories, training grounds, training and production bases for organizing the educational process for qualifications and specialties (with the exception of pedagogical colleges);

      3) presence of teachers of the highest and first category, expert teachers, research teachers, master teachers and Masters from the number of teachers (at least 30%);

      4) presence of full-time teachers and masters of industrial training of at least 70% (at least 50% for TVPSE organizations implementing educational programs in the field of art and culture);

      5) availability of social and living conditions for students (availability of a hostel owned by the right of ownership or lease, operational management, trust management and/or a hostel and/or a hotel) for students, catering and medical service points);

      6) availability of conditions for the persons with special educational needs (mandatory requirements: entrance ramps, light signals, call button, bathroom according to BCAR);

      7) availability of a document on the passage of institutional and/or specialized accreditation or state certification in accordance with Article 9-1 of the Law of the Republic of Kazakhstan "On Education";

      8) information about the employment and occupation of graduates in the first year after graduation from TVPSE organizations in the declared specialties.

      This requirement does not apply to TVPSE organizations that have applied for new specialties, as well as to specialties for which graduation was not carried out;

      9) coverage of students with dual training and/or internships at the workplace in the declared specialties;

      10) number of places for the admission of students, taking into account the possibility of TVPSE organization;

      11) availability of a website, an account in social networks.

      33. If it is not possible to obtain the documents and information specified in paragraph 32 from information systems, the Commission shall request supporting documents from educational organizations implementing educational programs of TVPSE.

      34. The Commission shall consider tender applications within 10 calendar days from the date of start of the Tender, determine the degree of their compliance with the requirements of the authorized body in the field of education for the TVPSE organization specified in paragraph 33 of these rules, for placing a state educational order and financing the training of TVPSE personnel and evaluate them in accordance with Appendix 6 to these Rules.

      35. The decision of the Commission to determine the list of TVPSE organizations in which, under the terms of the tender, a state educational order is placed for training personnel with TVPSE, indicating the specialty (qualification), the base and language of instruction, project opportunities shall be published within five working days on the Internet resources of the educational authorities of the region, the city of republican significance and the capital.

      36. The educational authorities of the region, cities of republican significance and the capital, in accordance with the order No. 578, shall carry out the distribution of the state educational order for the choice of applicants for TVPSE organizations approved by the decision of the Commission.

      37. In the presence of unallocated places for the state educational order, understaffing of groups in specialties (less than 15 people), uncovered applicants, the Commission shall take a decision on redistribution of the state educational order by specialties and organizations of TVPSE.

      38. The commission, following the results of distribution of the state educational order among applicants, as well as in accordance with the actual admission to educational organizations in which the state educational order is placed without a distribution procedure shall place a state educational order for the training of personnel with TVPSE.

      39. The decision of the Commission on placement of a state educational order for training of personnel with TVPSE in TVPSE organizations within five working days after the meetings shall be published on the Internet resources of the ABRS, educational authorities of the region, the city of republican significance and the capital until August 27 of the calendar year.

      The decision of the Commission shall be the basis for the formation of groups according to specialties, qualifications and workload of teachers of TVPSE organizations.

      40. On the basis of the decision of the Commission, by the order of the head of the ABRS, by a resolution of the local executive body of the region, cities of republican significance and the capital, a state educational order for training personnel in TVPSE organizations in accordance with Appendix 7 to these Rules shall be placed until September 1 of the calendar year.

Chapter 4. Placement of a state educational order for training personnel in organizations of higher and (or) postgraduate education, taking into account the needs of the labour market, for preparatory departments of higher educational institutions

      41. To place a state educational order for the training of personnel with higher and postgraduate education, the authorized body in the field of education shall annually announce a tender among higher educational institutions no later than 5 days before the start of accepting documents.

      The decision to hold a tender shall be drawn up by the order of the Minister or a person acting his/her duties.

      41-1. The volume of the state educational order for training of personnel with higher and postgraduate education shall be determined in accordance with the algorithm for calculating the volume of per capita regulatory financing of higher and postgraduate education, taking into account the credit technology of education, according to the Methodology. At the same time, per capita normative financing of higher and postgraduate education shall be carried out in accordance with the Rules for per capita normative financing.

      42. The announcement about the Tender shall be published on the Internet resources of the authorized body in the field of education and (or) the authorized body of the relevant sphere (hereinafter- ABRS).

      43. A Commission for the placement of a state educational order for training of personnel in organizations of higher and (or) postgraduate education (hereinafter-the Commission) shall be created for holding the Tender, the composition of which is approved by the order of the Minister or the person acting his/her duties.

      The Commission shall be formed from among the employees of the authorized body in the field of education, other interested state bodies and departments, representatives of civil society institutions, the National chamber of entrepreneurs of the Republic of Kazakhstan "Atameken", industry associations, the Association of higher educational institutions of the Republic of Kazakhstan and/or the Council of Rectors of higher educational institutions of the Republic Kazakhstan. The chairman of the commission shall be elected by a majority of votes from among the members of the commission. The number of members of the commission is odd, including its Chairman.

      44. Meetings of the Commission shall be held according to the plan approved by its chairman, and considered valid if they are attended by more than 2/3 of the total number of its members.

      45. Decisions of the Commission shall be taken by open voting by a simple majority of votes of the members of the Commission present at the meeting and shall be drawn up in the protocol of the meeting, which is signed by the chairman. In case of equality of votes, the vote of the chairman of the commission shall be decisive.

      46. ​​To participate in the tender for the placement of a state educational order for training of personnel with higher and postgraduate education, the OHPE shall submit a tender application in electronic format to the authorized body in the field of education and (or) the ABRS, including the following documents:

      1) an application of OHPE in the prescribed form in accordance with Appendix 8 to the Rules;

      2) an OHPE questionnaire in the prescribed form in accordance with Appendix 9 to the Rules;

      3) an OHPE information card in the prescribed form in accordance with Appendix 10 to the Rules;

      4) proposals for the placement of a state educational order for the training of personnel with higher and postgraduate education for the corresponding academic year in the prescribed form in accordance with Appendix 11 to the Rules.

      In the event of disputes regarding the indicators of the information card submitted by the OHPE, in accordance with subparagraph 3) of paragraph 46 of these Rules, the Commission shall request supporting documents.

      47. The documents included in the tender application shall be signed by the first head of the OHPE, certified with a seal and submitted in electronic format and (or) online through the information system in the manner specified in the announcement of the tender.

      At the same time, the information provided by the OHPE, if necessary, shall be verified for compliance with the data of the Unified education information system.

      48. The tender application shall be sent to the authorized body in the field of education and (or) to the ABRS in electronic format no later than the hour and date specified in the announcement of the tender. The tender application received after the deadline for submission of tender applications, regardless of the reasons for the delay, shall not be considered. Making any changes to the tender applications after the deadline for their submission shall not be allowed.

      49. The Commission shall consider tender applications and determine the degree of their compliance with the requirements for tender documentation and evaluate them in accordance with Appendix 12 to the Rules.

      50. OHPE that have passed institutional and (or) specialized accreditation in accreditation bodies entered in the register of recognized accreditation bodies, with the exception of military, special educational institutions shall participate in the tender for placement of a state educational order for training of personnel with higher and postgraduate education by groups of educational programs.

      The threshold value of the indicator of employment of graduates of the OHPE shall be determined by the Commission.

      The exception is new areas of personnel training that have received a license for the first time, as well as newly created OHPE for training personnel with higher and postgraduate education in priority sectors of the economy. At the same time, the list of OHPE shall be determined by the Commission.

      51. When determining the OHPE and placing a state educational order for the training of personnel with higher education, the Commission shall take into account the following main criteria:

      1) presence of a contingent of students in the relevant group of educational programs, with the exception of areas included for the first time in the Classifier of areas for training personnel with higher and postgraduate education of the Republic of Kazakhstan;

      2) personnel support of OHPE and material and technical support of the scientific and educational process;

      3) provision of educational, teaching and methodological literature and other information resources;

      4) scientific potential and the level of scientific researches, conducted in the OHPE (for the OHPE);

      5) availability of accommodation for students in the dormitory, public catering and medical services;

      6) availability of accredited educational programs;

      7) demand and employment of graduates;

      8) participation in the international and/or national ratings of the OHPE;

      9) position of the OHPE in the rating conducted by NCE "Atameken".

      52. When determining the OHPE and placing a state educational order for the training of personnel with postgraduate education, including target places in doctoral studies, the Commission shall take into account the following main criteria:

      1) participation in the international and/or national ratings of the OHPE;

      2) availability of agreements with accredited scientific partner organizations, including foreign ones, on the implementation of joint scientific projects and the provision of a research base;

      3) presence of scientific supervisors from among the teaching staff of the OHPE with academic degrees of Doctor of Science/ Candidate of Science, and degrees of Doctor of Philosophy (PhD)/Doctor in profile;

      4) implementation of joint scientific and educational projects with foreign partner universities (scientific organizations);

      5) staffing of the scientific and educational process and meeting the requirements for engaging in educational activities in educational programs of postgraduate education (for the group of specialties "Art", including teachers awarded honorary titles and state awards of the Republic of Kazakhstan);

      6) access to world scientific and educational resources; material and technical support of the scientific and educational process that meets the requirements for engaging in educational activities in educational programs of postgraduate education;

      7) availability of accredited educational programs;

      8) implementation of scientific and scientific-technical programs and projects on the basis of grant, program-targeted financing and other sources;

      9) availability of places for students to live in a hostel, points of public catering and medical care in the OHPE;

      10) information on the employment and occupation of graduates in the first year after graduation from the OHPE in the declared specialties.

      53. The admission of OHPE to the tender in which doctoral graduates have completed their studies and have not received the approval of the degree of Doctor of Philosophy (PhD), doctor in the profile within 4 years after graduation in the corresponding group of educational programs shall be carried out by decision of the commission.

      54. To participate in the tender for the placement of a state educational order for training students at the preparatory department of the OHPE, a tender application shall be submitted in electronic format to the authorized body in the field of education and (or) to the ABRS, which includes the following documents:

      1) an application of OHPE in the prescribed form in accordance with Appendix 13 to the Rules;

      2) an OHPE questionnaire in the prescribed form in accordance with Appendix 9 to the Rules;

      3) proposals for placement of a state educational order for training students at the preparatory department for the corresponding academic year in the prescribed form in accordance with Appendix 14 to the Rules.

      55. When determining the OHPE and placing a state educational order for training students at the preparatory department, the Commission shall be guided by the following main criteria:

      1) personnel and material-technical support of the educational process and the level of qualification of teachers, availability of teachers in all subjects of the Comprehensive testing of applicants;

      2) provision with educational, educational and methodical literature and other information resources;

      3) availability of places for students to live in a hostel, points of public catering and medical care in the OHPE.

      56. The tender for higher educational institutions shall be held separately for groups of educational programs of higher and postgraduate education.

      57. The commission, taking into account the assessment shall make a decision on placing a state educational order for the training of personnel with higher and postgraduate education, indicating:

      1) a list of OHPE, in which, under the terms of the tender, a state educational order for the training of personnel with higher education is placed;

      2) a list of OHPE, in which, under the terms of the tender, a state educational order for training personnel in the magistracy is placed, including an indication of the volume of the quota for individual OHPE;

      3) a list of basic OHPE, in which, according to the terms of the tender, a state educational order is placed for the training of personnel in doctoral studies, indicating the volume by groups of educational programs, including for the targeted training of doctors of philosophy (PhD)/doctors in the profile;

      4) OHPE, in which the state educational order is placed for training students at the preparatory departments of OHPE, including for improving the level of language training, indicating the volume;

      5) OHPE, in which, according to the terms of the tender, a state educational order is placed for the training of teachers with higher education, indicating the volume by groups of educational programs.

      58. Based on the results of the work of the tender commission, placement of a state educational order for the training of personnel with higher and postgraduate education shall be approved by the order of the Minister or the person acting his/her duties and published on the Internet resources of the authorized body in the field of education and (or) in the ABRS

Chapter 5. Placement of a state educational order for secondary education

      59. The state educational order placed in secondary education organizations must contain the number of students and the average cost of expenses per student.

      60. The volume of the state educational order for secondary education shall be determined in accordance with the algorithm for calculating the per capita normative financing of secondary education, according to the Methodology. At the same time, per capita normative financing of secondary education shall be carried out in accordance with the Rules for per capita normative financing.

Paragraph 1. Placement of a state educational order for secondary education in state educational organizations

      61. The local executive body shall annually post information on the start of accepting applications from state educational organizations for placing a state educational order for secondary education on the Internet resources:

      1) for the upcoming academic year - until June 1 of the calendar year;

      2) during the calendar year for newly created or reorganized state educational organizations - within the period established by the local executive body independently.

      62. To place a state educational order for secondary education, a state educational organization shall submit to the local executive body an application, in the form according to Appendix 15 to these Rules, with the attached documents within 30 calendar days from the date of placement of information about the start of accepting applications from state educational organizations for placing a state educational order for secondary education by the local executive body on the Internet resources:

      1) for the upcoming academic year - no later than July 1 of the calendar year;

      2) during the calendar year for newly created or reorganized state educational organizations - within the period established by the local executive body independently.

      With the application, the state educational organization shall submit the local executive body the following documents:

      1) a copy of the license to engage in educational activities in general educational curricula of primary, basic secondary, general secondary education, issued in the form approved by the order of the Minister of National Economy of the Republic of Kazakhstan dated January 6, 2015 No. 3 “On approval of application forms for obtaining and reissuing a license and (or) an appendix to the license, forms of licenses and (or) appendices to licenses” (registered in the Register of state registration of regulatory legal acts under No. 10195) (hereinafter - Order of the Minister of National Economy of the Republic of Kazakhstan dated January 6, 2015 No. 3);

      2) a certificate of state registration (re-registration) of a legal entity.

      63. The local executive body shall consider applications from state educational organizations with attached documents for placing a state educational order within fifteen working days from the date of their registration:

      1) for the upcoming academic year - no later than August 1 of the calendar year;

      2) during the calendar year for newly created or reorganized state educational organizations - within the period established by the local executive body independently.

      When considering applications from state educational organizations with attached documents, the local executive body shall check the completeness of the submitted documents.

      If it is revealed that the state educational organization has submitted an application and (or) documents attached to it that do not comply with these Rules, the local executive body within 3 working days shall send a notification of the need to eliminate discrepancies to the state educational organization to the e-mail specified in the application, or, in the absence of e-mail, to the postal address, specified in the application.

      The state educational organization re-submits the application brought in accordance with these Rules and the documents attached to it to the local executive body within 3 working days from the date of sending the notification by e-mail or receiving it at the postal address.

      The local executive body, within 3 working days from the date of receipt of the repeated application of the state educational organization with the attached documents, shall consider them.

      64. The local executive body, no later than 60 calendar days from the date of posting information on the Internet resources about the start of accepting applications from state educational organizations shall form a list of state educational organizations for placing a state educational order for secondary education, indicating the number of places and publish it on the Internet resources.

      State educational organizations with a previously placed state educational order for secondary education shall be included in the list of state educational organizations for placing a state educational order for secondary education without submitting an application.

      The local executive body shall place a state educational order for secondary education by carrying out the procedure for concluding an agreement with a state educational organization included in the list of state educational organizations for placing a state educational order for secondary education.

Paragraph 2. Placement of a state educational order for secondary education in private educational organizations

      65. Placement of a state educational order for secondary education in private educational organizations shall be carried out by the operator of the authorized body in the field of education (hereinafter- the operator).

      66. The operator shall annually post information about the start of accepting applications from private educational organizations for placing a state educational order for secondary education on the Internet resource:

      1) for the upcoming academic year - until June 1 of the calendar year;

      2) within a calendar year for private educational organizations, submitting an application to the operator for the first time in order to place a state educational order for secondary education - within the time period established by the operator independently.

      67. To place a state educational order for secondary education, a private educational organization shall submit to the operator an application, in the form according to Appendix 16 to these Rules, with the attached documents within 30 calendar days from the date the operator posted information on the Internet resource about the start of accepting applications from private educational organizations to place the state educational order for secondary education.

      With the application, the private educational organization shall submit to the operator the following documents:

      1) a copy of the license to engage in educational activities in general educational curricula of primary, basic secondary, general secondary education, issued in the form approved by the order of the Minister of National Economy of the Republic of Kazakhstan dated January 6, 2015 No. 3;

      2) a certificate of state registration (re-registration) of a legal entity;

      3) a certificate on availability of an account in a second-tier bank of the Republic of Kazakhstan.

      4) a copy of the current preliminary agreement concluded between the operator and the private educational organization in the form approved by the operator - for private secondary education organizations with newly introduced student places in the facilities of private educational organizations, provided for by the Methodology.

      68. The operator shall consider applications from private educational organizations with attached documents for placing a state educational order within fifteen working days from the date of their registration.

      When considering applications and documents of private educational organizations, the operator shall check the completeness of the submitted documents.

      If it is revealed that a private educational organization has submitted an application and (or) documents attached to it that do not comply with these Rules, or if the private educational organization is not registered on the public procurement web portal, the operator within 3 working days shall send a notification about the need to eliminate inconsistencies to the private educational organization to the e-mail indicated in the application, or, in the absence of e-mail, to the postal address indicated in the application.

      Within 3 working days from the date of sending the notification by e-mail or receiving it at the postal address, the private educational organization re-submits to the operator the application brought in accordance with these Rules and the documents attached to it.

      The operator, within 3 working days from the date of receipt of a repeated application of a private educational organization with the attached documents shall carry out their consideration.

      In case of repeated detection of the fact that a private educational organization has submitted an application and (or) documents attached to it that do not comply with these Rules, or in the absence of registration of a private educational organization on the public procurement web portal, the operator shall send a justified and reasoned refusal to place a state educational order for secondary education to the private educational organization to the postal address or e-mail specified in the application.

      When private educational organizations registered on the public procurement web portal submit applications and documents, complying with these Rules, the operator, no later than 60 calendar days from the date of posting information on the start of accepting applications from private educational organizations on the Internet resource shall form a list of private educational organizations for placement of a state educational order for secondary education indicating the number of places and publish it on the Internet resource.

      Private educational organizations with a state educational order for secondary education previously placed by the operator or a local executive body shall be included in the list of private educational organizations for placing a state educational order for secondary education without providing the operator with the documents specified in paragraph 67 of these Rules for the application.

      69. The operator shall place a state educational order for secondary education by carrying out the procedure for concluding an agreement with a private educational organization.

Chapter 6. Placement of a state educational order for the training of personnel in organizations of higher and (or) postgraduate education, taking into account the needs of the labour market by local executive bodies

      70. To place a state educational order for the training of personnel with higher and postgraduate education, local executive bodies of the region, city of republican significance, the capital (hereinafter-LEB) shall annually announce a tender among higher educational institutions no later than 5 (five) days before the start of accepting documents for participation in the tender for training under the state educational order at the expense of LEB funds.

      The decision to hold a tender shall be drawn up by the order of the akim of the relevant region, city of republican significance, the capital or the person acting his/her duties.

      The announcement of the tender shall be published on the Internet resources of the LEB.

      To conduct the tender, the LEB Commission shall be created for the placement of a state educational order for the training of personnel with higher and postgraduate education (hereinafter- the LEB Commission), the composition of which is approved by the order of the akim of the relevant region, city of republican significance, the capital or the person acting his/her duties.

      The chairman of the LEB Commission shall be the akim of the relevant region, city of republican significance, the capital, or the person acting his/her duties. The LEB commission shall be formed from among the LEB employees, representatives of civil society institutions located in a given territorial unit. The number of members of the LEB Commission is odd, including its chairman.

      Meetings of the LEB Commission shall be considered valid if they are attended by more than two thirds of the total number of its members.

      Decisions of the LEB Commission shall be adopted by open voting by a simple majority of votes of the members of the Commission present at the meeting and shall be drawn up in the protocol of the meeting, which is signed by all members of the Commission participating in the meeting.

      To participate in the tender for the placement of a state educational order for the training of personnel with higher and postgraduate education, higher educational institutions shall submit to the LEB in electronic format a tender application that includes the following documents:

      1) an application of a higher educational institution in the prescribed form according to Appendix 17 to these Rules;

      2) a questionnaire of the higher educational institution in the prescribed form according to Appendix 9 to these Rules;

      3) proposals for the placement of a state educational order for the training of personnel with higher and postgraduate education for the corresponding academic year in the prescribed form, according to Appendix 11 to these Rules.

      The documents included in the tender application shall be numbered, signed by the first head of higher educational institution and certified with a seal and submitted in the order specified in the announcement of the tender in electronic format.

      The tender application shall be sent to the LEB no later than the hour and date specified in the announcement of the tender. A tender application received after the deadline for submission of tender applications, regardless of the reasons for the delay shall not be considered. Making any changes to the tender applications after the deadline for their submission shall not be allowed.

      The LEB commission shall consider tender applications within 5 (five) calendar days from the date of application submission, determine the degree of their compliance with the requirements for the tender documentation.

      When determining higher educational institutions and placing a state educational order for the training of personnel with higher and postgraduate education in the context of specialties, the LEB commission shall be guided by the main criteria specified in paragraphs 51 and 52 of these Rules. The state educational order for the training of personnel with higher and postgraduate education of the LEB shall be placed in higher educational institutions, regardless of the administrative-territorial unit. At the same time, the state educational order for the training of personnel with higher and postgraduate education shall be placed in higher educational institutions, taking into account the established quotas, as well as allocation of target places for certain categories of applicants.

      Based on the results of the work of the LEB commission, a list of higher educational institutions shall be published on the Internet resources, which place a state educational order for the training of personnel with higher and postgraduate education, approved by the decision of the akimat of the relevant region, city of republican significance, the capital.

      Citizens of the Republic of Kazakhstan who enter on the basis of a state educational order at the expense of LEB shall conclude an agreement on working out for at least 3 (three) years in the relevant region or in the cities of republican significance, the capital.

Chapter 7. Placement of a state educational order for additional education of children by local executive bodies

      71. Local executive bodies of a region, a city of republican significance, the capital shall place a state educational order for additional education of children in organizations, regardless of the form of ownership, implementing educational programs for additional education of children (hereinafter - Organizations) and determine the average cost of maintenance per child.

      72. To place a state educational order for additional education of children, local executive bodies of the region, city of republican significance, the capital, on the basis of applications from education departments, shall determine the volume of the state order for additional education of children and place an announcement on the official Internet resource on the number of places by types and directions of additional education, the average cost per child by locality, and the minimum requirements for educational programs of additional education for children.

      73. The state educational order for additional education of children shall be placed in Organizations, the charter (regulation, constituent agreement) of which provides for activities in the field of additional education of children with registration in the information system "National Educational Database" indicating ongoing educational programs for additional education of children on the basis of an application in the form according to Appendix 18 to these Rules.

      74. To form a list of Organizations for placing a state educational order for additional education of children, the educational authorities of the region, city of republican significance, the capital shall create Commissions (hereinafter - the Commission). The commissions are a permanent consultative and advisory body. The composition of the Commission shall be approved by the local executive body of the region, city of republican significance, the capital.

      75. The commission shall be formed from among representatives of maslikhats, akimats, educational authorities of the region, city of republican significance, the capital, district (city), non-governmental organizations involved in the issues of education and upbringing of children, the regional chamber of entrepreneurs.

      76. The number of members of the Commission is odd. The Chairman of the Commission shall be the head of the education authority of the region, city of republican significance, the capital, district (city) or his/her deputy.

      77. To be included in the list of Organizations, to place a state educational order for additional education of children, the Organization shall submit an application addressed to the chairman of the Commission in the form according to Appendix 19 to these Rules to the educational authorities of the region, city of republican significance, the capital, district (city) and the following the documents:

      1) a copy of the sanitary and epidemiological conclusion on compliance of the building/premises of the Organization with sanitary and epidemiological requirements in accordance with Order No. KR MHC-336/2020, with a date not earlier than one month before the submission of documents;

      2) a certificate or a copy of the certificate of state registration (re-registration) of a legal entity or an individual entrepreneur, the charter of the Organization (regulations, memorandum of association);

      3) information on the absence of tax debts and debts on mandatory pension contributions, mandatory professional pension contributions and social contributions in an amount exceeding six times the monthly calculation index established for the corresponding financial year by the law on the republican budget, with a date not earlier than one month before the submission of documents;

      4) a copy of title documents for real estate or a copy of the lease agreement used for the Organization;

      5) educational programs of additional education for children;

      6) a copy of documents of teachers on pedagogical or vocational education, qualification level;

      7) copies of documents confirming the work experience of the Organization (if any)) (in accordance with the charter, with constituent documents, contracts), or a letter about the lack of work experience of the Organization.

      78. Documents of the Organization submitted for inclusion in the list of Organizations for placing a state educational order for additional education of children shall be laced, numbered, signed by the head of the Organization, certified with a seal (if any) or signature of the head.

      79. The submitted documents shall be considered by the Commission at the meeting within 10 working days. The commission shall create working groups for preliminary study of documents.

      80. Criteria for selecting Organizations to place a state educational order for additional education for children:

      1) availability of a sanitary and epidemiological conclusion on compliance of the building/premises of the Organization with sanitary and epidemiological requirements in accordance with the Order No. KR MHC-336/2020, with a date not earlier than one month before the submission of documents;

      2) availability of a certificate or a copy of the certificate of state registration (re-registration) of a legal entity or individual entrepreneur, the charter of the Organization (regulations, memorandum of association);

      3) availability of information on the absence of tax debts and debts on mandatory pension contributions, mandatory professional pension contributions and social contributions in an amount exceeding six times the monthly calculation index established for the corresponding financial year by the law on the republican budget, with a date not earlier than one month before the submission of documents;

      4) availability of a copy of title documents for real estate or a copy of a lease agreement used for the Organization;

      5) availability for Organizations of educational programs copies of additional education for children in accordance with paragraph 3 of Article 23 of the Law of the Republic of Kazakhstan "On Education".

      The content of the educational program includes goals and objectives, terms of study, content, amount of knowledge, skills, abilities and competencies for mastering, expected learning outcomes, means of achieving goals and objectives.

      6) availability of copies of documents of teachers on pedagogical or vocational education, qualification level;

      7) availability of copies of documents confirming the work experience of the Organization (if any)) (in accordance with the charter, with constituent documents, contracts), or a letter about the lack of work experience of the Organization;

      8) the proportion of teachers of the highest and first category, experts, researchers, masters of their total number is at least 10 percent.

      81. Based on the results of consideration of documents, the Commission shall make one of the following decisions:

      1) to include in the list of Organizations for placement of a state educational order for additional education of children;

      2) to refuse to be included in the list of Organizations for placement of a state educational order for additional education of children in the Organization in case of non-compliance with the criteria specified in paragraph 80 of these Rules.

      82. By a majority vote of the members of the commission by open voting, the decision shall be considered adopted.

      In case of equality of votes of the members of the Commission, the vote of the chairman of the Commission shall be decisive.

      83. The decision of the commission shall be drawn up in a protocol.

      84. The protocol shall be signed by the chairman and all members of the Commission who participated in the meeting.

      85. Meetings of the Commission shall be considered valid if more than half of the total number of its members are present.

      86. The decision to include in the list of Organizations for placing a state educational order for additional education of children shall be published on the Internet resources of the educational authorities of the region, city of republican significance, the capital, district (city) within five working days from the date of the decision.

      87. Based on the decision of the Commission, the educational authorities of the region, city of republican significance, the capital, district (city) shall post information about the Organizations included in the list of Organizations for placing a state educational order for additional education of children, containing the organization name, its legal address, location, data on educational programs of additional education, the amount of hours, languages ​​of instruction, the start of accepting applications, additional admission during the year based on applications from parents (legal representatives) if there are vacancies, about admission to the Organization in accordance with the Rules for the provision of public services "Acceptance of documents and enrollment in organizations of additional education for children to provide them with additional education", approved by the order of the Minister of Education and Science of the Republic of Kazakhstan dated May 22, 2020 No. 219 (registered in the Register of state registration of regulatory legal acts under No. 20695), on the formation of a contingent of children to receive a state educational order for additional education of children in accordance with the “National Educational Database” on available resources: the official website, official accounts in social networks.

      88. The organization concludes agreements with the educational authorities of the region, city of republican significance, the capital, district (city) for the provision of educational services for additional education of children, indicating the number of places under the state educational order for additional education of children.

      89. The provision of services by the Organization shall be carried out on the basis of an agreement concluded between the Organization and parents or other legal representatives in the manner prescribed by the civil legislation of the Republic of Kazakhstan. The conditions for the provision by the Organization of paid services for conducting classes not provided for by the state educational order for additional education of children, according to the established cost at the request of parents or other legal representatives shall be provided for by the specified agreement.

      90. The educational authority of the region, city of republican significance, the capital, district (city) pays the cost of services for additional education of children:

      1) upon the fact of attending (staying) classes according to the schedule;

      2) absent from group classes for a valid reason (illness, treatment, health improvement and rehabilitation in medical, sanatorium and resort organizations with the provision of supporting documents, no more than 10 days), when one of the parents or other legal representatives is provided with labour leave, no more than two months (if there is an application).

      The organization provides for independent study the educational material of group classes for the period of absence for a good reason of children in the classroom.

      91. The state educational order for additional education of children shall not be paid for children who were absent from individual classes due to illness, treatment, health improvement and rehabilitation in medical, sanatorium and resort organizations, vacation of one of the parents or other legal representatives, and for invalid reasons.

      In cases when a child is absent for valid reasons (illness, treatment, health improvement and rehabilitation in medical, sanatorium and resort organizations, vacation of one of the parents or other legal representatives), classes shall be organized according to an individual schedule or remotely based on the application of parents or other legal representatives.

      Based on the results of additional individual lessons of the Organization, the state educational order for additional education of children shall be paid in full.

      92. When recruiting a contingent of children under the state educational order for additional education of children, the Organizations shall be guided by the formed priority list.

      In case of the release of places within the framework of the state educational order for additional education of children, the organization shall accept children from the formed priority list.

      93. On the 1st day of each subsequent month, the organization shall issue an act of services rendered with the attachment of information downloaded from the information system "National Educational Database" as of the last working day of the month, with the exception of December, for which the act of services rendered with the attachment of information downloaded from the information system "National Educational Database" shall be issued as of December 15.

      94. Representatives of the educational authorities of the region, city of republican significance, the capital, district (city) shall monitor the activities of the Organizations to fulfill the obligations stipulated by the contract for the placement of the state educational order for additional education of children and provide methodological and advisory assistance.

      95. If facts of non-compliance of the Organization with the criteria specified in paragraph 80 of these Rules are revealed, the educational authorities of the region, city of republican significance, the capital, district (city) within 3 working days shall send a notification of the need to eliminate inconsistencies to the Organization to the e-mail specified in the application, or, in the absence of e-mail, to the postal address, specified in the application.

      Within one month from the date of sending the notification by e-mail or receiving it at the postal address, the Organization re-submits the documents brought in accordance with paragraph 80 of these Rules.

      In the event of a repeated non-compliance, the Organization shall be subject to exclusion from the list of Organizations for placing a state educational order for additional education of children based on the relevant decision of the Commission

      96. The placement of the state educational order for additional education of children to new and additional places, to the places of the branches of the Organization with previously placed places shall be carried out if the new and additional places comply with subparagraph 1 of paragraph 80 of these Rules, when the founder of the Organization changes, the placed state educational order for additional education of children shall be retained if the Organization meets the criteria specified in paragraph 80 of these Rules.

      97. The organization, based on the results of mastering the educational program of additional education for children, at the end of the academic year shall issue a document (certificate) confirming the results of training, in accordance with Appendix 20 to these Rules in electronic or paper form.
